Brütal Legend Dev Counter-Sues Activision


The ongoing battle over the fate of Activision [http://www.brutallegend.com/home.action], claiming the publishing giant is trying to kill the game to protect the Guitar Hero franchise from competition.

Despite apparently dropping the game in the wake of its acquisition by Vivendi, Activision EA [http://www.escapistmagazine.com/news/view/92199-Activision-Suing-To-Stop-Brutal-Legend-Release] is allowed to publish the game.

But Double Fine is pushing back with a lawsuit of its own, claiming Activision's real goal "is not only to cancel Brütal Legend, but to kill it completely." The counter-suit alleges that Activision is attempting to hurt both the game and Double Fine Productions itself as part of a conspiracy to protect its Guitar Hero [http://www.guitarhero.com] franchise from competition. In fact, Double Fine claims in the suit that Activision pulled the plug on the game after it tried and failed to convert Brütal Legend into a Guitar Hero sequel.

"Now that we've found a publisher and the game is getting sensational coverage, they want to stop its release," said Double Fine CEO Caroline Esmurdoc. "Double Fine's countersuit is a demonstration of our intention to fight for this game - Activision will not kill Brütal Legend."

Claiming that its very survival depends upon a successful release of Brütal Legend, Double Fine is seeking a judgment declaring that Activision did actually terminate its agreement with the developer and that it was free to sell the game to EA as a result. A hearing into Activision's original lawsuit, meanwhile, is scheduled for July 30.

Seems like it. Dammit Activision, get your panties out of a knot and stop being douches to everyone. I want Brutal Legend, and I hope that these lawsuits don't cancel it.

Ever since they became the largest developer in the industry they've been far worse than EA has even been in my books. I can't help but cheer on Double Fine and wish them all the best in their case.

How is Activision going to suffer irreparable harm from somebody releasing a game they didn't want. Maybe they should sue Valve for releasing Left 4 Dead 2 because it will cause them harm by detracting sales away away from CoD6.

btw, i was on brutal legends side all the way but even if this want the case it would be funny for someone to bite back at activision

I agree, they're just being total whiney pussies and being all "Well if that game is made, people won't buy ours!"

Last time I checked Activision, that was called competitive sales.

Something's terribly wrong with the video game industry.

EA being nice? Activision being evil? Someone has upset the balance!

Oh well, at least Molyneux's still being a pretentious git, if that changes we're all fucked!

ground level clouds aside any schafer game is a welcome event, activision are acting like that girlfriend who dumped you for her own selfish reasons only to get jealous and midnight stalking psychotic when you find a new girl.
