Swedish Court Rejects Pirate Bay Appeal

Rather than make things better for the Pirate Bay quartet, a Swedish appeals court has made things much worse, adding nearly $5 million to the total damages.

A court in Sweden has rejected the appeal of the three founders of the Pirate Bay torrent site Gottfrid Svartholm Warg, Fredrik Neij, Peter Sunde, and their backer Carl Lundstrom, following their conviction for assisting copyright infringement earlier in the year.

Svartholm, Neij, Sunde and Lundstrom, were convicted in April after a tend day long trail and ordered to serve a year in prison, plus pay a collective fine of $2 million.

They appealed the verdict, but the appeals court upheld the convictions from April for three of the four men - the youngest member of the quartet, Svartholm, was unable to attend court due to illness, so his case will be heard separately. The court also tweaked the sentences a little, decreasing the amount of jail time each man would serve from a year to between four and ten months, but increasing their collective fines from $2 million to $6.5 million.

Following the verdict, Sunde tweeted [http://twitter.com/#!/brokep/status/8151177476706304] that the court's decision was wrong and they should have looked at the evidence properly and come to a better judgment. Defense lawyers for Neij and Lundstrom said that they were disappointed, but not surprised by the verdict, and said that they would probably take the matter to the European Supreme Court.

Considering the claims on the site where they brag about how they've never been sued or shut down due to Copyright infringement, this is HILARIOUS!

The way they talk back and pretty much attempt to mock those that send them C&D letters was always balking, so it's nice to see them getting this

NO! The Europeans apparently don't realize that killing the TPB will accomplish nothing, and that even if the site dies, others will take on the pirate mantle.

Shock and awe. Is anyone actually surprised by this? The courts see torrent sights as a modern day bootlegging booth in the slums of New Delhi, the only difference is they have access to more people than a kid yelling in the street. Well, that and their information is a little more accurate.

Look, their site was CALLED PIRATE BAY. They actually advertised their crime. They got what they deserved.

It caused the court to rearrange the sentence to increase the fine and lessen the jail time.

Edit: So it didn't increase the sentence itself just rearranged it.

Well can't say I'm surprised, though in the long run shutting down Pirate Bay is only going to make people be even more subtle and more able at not getting caught pirating.

I'm not against piracy but, come on they were fucking waving a flag around and bragging about it a little too much.

E.g. the site name, the logo, just the general way they showed their ego off.

Meh nothing to see here, all these open attacks don't really do anything but encourage pirates further, it's kind of like the internet version of terrorism. A lot of governments are probably going to regret pissing off a lot of nerds with excellent computer skills eventually.

I know, they were basically like "lol, we're untouchable! KING KONG AIN'T GOT SHIT ON US!"

Then they got their asses sued.

I know this won't fix the problem, but I still find it hilarious.

when did they change the laws?. It was previously not illegal in Sweden to host a torrent site. That is why they were so proud to not be caught, because they resided in a country where it was legal to host the site.

And good luck getting heard by the General Court let alone the ECJ.
