Marilyn Monroe Saves EA From John Dillinger


The family of John Dillinger has lost a lawsuit against EA and it's all Marilyn Monroe's fault.

Back in September of 2009, the family of notorious 30s gangster John Dillinger The Godfather 2 [sued Electronic Arts]. His family claimed EA had violated their right of publicity with the game and they were after some big bucks in compensation.

EA opted to roll the dice in the courtroom and it turned out to be a smart move, as a judge in the U.S. District Court of Southern Indiana ruled in favor of the publisher yesterday. The family cited a 2006 case in which a judge in Lake County, Indiana ruled that the state's right to publicity law should be applied retroactively with regards to the county's use of the name to promote a Dillinger museum.

But Electronic Arts returned fire with a 2007 case in which a New York judge ruled that descendants of Marilyn Monroe could not claim similar rights because the actress died before the law was enacted. The judge sided with EA, declaring that the Indiana Supreme Court would likely also rule that the statute does not apply to Dillinger because his death predated the law. The judge further ruled that EA's use of the name was protected under the First Amendment because Dillinger has become so closely associated with the Thompson submachine gun in popular culture.

Is this newsworthy?
It barely caused a chuckle.
It's interesting, don't get me the wrong way, but I think that today might be a slow day.

Oh, I remember the Dillinger from that game.

NASTY weapon, let me tell you. Just felt so powerful in one's hands.

I do have to wonder why these kinds of cases always take so long to take their course.

One single reference ain't exactly a huge infringement, folks.
I'm pretty sure they could have used "We named it so for comical/satirical effect" as a defense as well. Satire is very well protected in law from copyright blah.

i think they're just trying to play off of all the EA hate that practically pervades every aspect of this site where commenters comment.

When i was a kid, i had a dog named Shepard who was a real A-hole. Does that mean i get to sue Bioware?

Nope, I'm afraid Religion gets to sue Shepard, because clearly Shepard is herding people together to safety, and only one person is allowed to do that, and we all know who that is.

OT: Interesting tidbit here. Not every story has to be groundbreaking game news. This is the same reason I listen to NPR when I'm driving around. The small stories that make you go "huh?"

I find it amusing that relatives of a murderous criminal were trying to squeeze money through a lawsuit.

Not very shocking, but certainly amusing.

Have you not heard? We hate Activision now. EA are all good since they have bioware.
