Activision Pays Out to Former Infinity Ward Employees


Activision has paid out $42 million to former Infinity Ward employees but its dispute with the studio's co-founders continues.

In what I'm pretty sure qualifies as an unexpected development, Activision has handed over $42 million to lawyers representing a group of former Infinity Ward employees who had sued the publisher over unpaid bonuses for Modern Warfare 3 [http://www.amazon.com/Call-Duty-Modern-Warfare-Xbox-360/dp/B00269QLI8/ref=sr_1_1?ie=UTF8&qid=1337097133&sr=8-1], mind you, which came out last year, but Modern Warfare 2, from all the way back in 2009. The amount included ten percent interest and comes on top of the $22 million already paid out to the studio.

The payout to the former employees, collectively known as the Infinity Ward Employee Group, is unrelated to the lawsuit filed against Activision by Infinity Ward co-founders Jason West and Vince Zampella, whose employment was terminated [http://www.escapistmagazine.com/news/view/98761-Rumor-Security-Locks-Down-Infinity-Ward-Ousts-Studio-Head-UPDATE] in 2010 over allegations of insubordination. It's not a settlement, either, which means that the IWEG lawsuit against Activision can, and will, go ahead.

"We are seeking all kinds of bonuses per the contract," attorney Bruce Isaacs told Polygon [http://www.theverge.com/gaming/2012/5/14/3020671/activision-pays-42m-to-former-infinity-ward-devs-not-a-settlement]. "This payment relates to one particular game and one particular time period and one particular bonus."

As to why the payment is just arriving now, Isaacs called it a "cynical attempt to look good before the jury trial."

"I can confirm for you that it happened today," he said. "I can also tell you that although it is a meaningful payment it is only a small portion of what we are seeking in litigation. It is outrageous that they made us wait, they obviously knew they owed the money and this just shows that they breached the contract."

Activision has filed a $400 million counter-claim against West, Zampella and rival publisher Electronic Arts, alleging that EA is unlawfully responsible for the duo's defection. The trial is set to begin later this month.

Why don't we make this a bit more interesting? I'm sure there's an army base or gun nut willing to conveniently lend out some hardware in order to settle this dispute once and for all.

The good part about making a fantastically profitable and high-selling game is supposed to be that you can pay everyone what they are owed and NOT get sued. To make a hugely successful game and then screw it up by still getting sued for non-payment of contractually owed fees seems quite silly, unnecessary and retarded.

Well, I guess the idea is that, while they(activision) could pay Ininity Ward for MW2, they could also keep that money for themselves, thus having more money... So yes, its quite silly, unnecessary and retarded.

Heh, bad move. Now public opinion on them is going to fall based on "well you were clearly wrong, that's why you paid them just before the trial".

Its a shame that these employees had to be stuck with two bosses dickish enough to get them screwed over in their attempt to screw over Activision.

Glad they finally got paid though.

Not really. If there was only 200 employees with 42mil that would equal 210,000 a person. That is going under the assumption that no lawyer fees will be taken out of that amount and that not very many people work there. While $210,000 may seem like a lot of money its honestly not enough to make any change in your life. Half of that will go straight to the govt in taxes leaving you with $105,000. In reality though I would imagine there is far more then 200 employees and there will be lawyer fees taken off of that money. I would be surprised if in the end each individual got more then $30,000-40,000.
Do you really have no concept of money? $200,000 is life changing money for most people. Even $30K-40K is a half a years salary for most developers.
