Apple Gets Samsung's Galaxy Tab Banned in the US

District Judge sides with Apple in patent dispute against Samsung.

Apple has triumphed in one of its numerous patent disputes with Samsung over the design of the two companies' tablets. A US District Court Judge of California has issued a preliminary injunction against the Samsung Galaxy Tab 10.1, which will ban its sale and import in the US.

Apple and Samsung have been mired in patent wars for quite some time, with Samsung has since been called into question [http://www.escapistmagazine.com/news/view/113180-Samsung-Apple-Continue-Patent-Catfight]. Samsung both sells its own hardware and manufactures hardware for other companies, including Apple, making the legal disputes between the companies even stickier.

Lucy Koh, the district judge who had previously denied the injunction in December, reversed her decision a few days before a hearing on the injunction was scheduled. Koh further elaborated in her decision that, "Apple's interest in enforcing its patent rights is particularly strong because it has presented a strong case on the merits," an assertion that doesn't look good for Samsung.

Before the ban can take effect, Apple must put down a $2.6 million bond, which is more than doable for the technology juggernaut. If the injunction is later reversed, Samsung will receive the bond from Apple as compensation for its losses. The Galaxy Tab 2, which was released after the injunction request, will not be affected.

Nonsensical legal quibbling. That tablet clearly has SAMSUNG along its bottom edge...

Unless of course that image of the 2, not the first one. Even then the design is quite different, although granted also quite similar.

It wouldn't matter if the two products were identical, there would still be one glaring difference between them. The fact that Apple continues to sell the same products for at least twice the price astounds me. Jobs, for all his faults, was clearly a first-class salesman.

So to say that people will confuse the two products is false. People may look at the Samsung and say, "Wow, that iPad is really cheap! That is one fantastic deal!", but I think once they look at the box and see that it has a big Samsung logo on it the confusion will be over. Then maybe they'll realize that an iPad for this price isn't cheap. An iPad for the regular price is simply expensive. Ridiculously so.

Apple - n: Overpriced status symbol that you throw away and replace when it breaks.

I would take a Samsung Galaxy Tab any day of the week. Too bad I didn't pick one up when I had the chance.

It's essentially a handheld monitor, and monitors all look the bloody same, which is why they have the logo written on them. This just seems rather pathetic.

Seems like Apple will sue anyone for anything vaguely resembling their iFad products. Aren't they currently in another legal dispute over the Samsung Galaxy S3? It would be nice if companies would refuse to make the chips for Apples products so that they'd either A) Stop with the legal bullshit or B)Start making their own chips and fail.

Well, to be fair, the Galaxy Tab 2 is exempt from this ban, so you could always pick one of those up.

Are they? I hope Apple loses that, because I'm looking forward to upgrading to a Galaxy S3 this Christmas.

Tablets always seemed plain and almost featureless to me. Basicly just a small flatscreen without the stand.
I don't see the original design here.

I seriously hope someone unbans the tablets (though I live in Canada so it shouldn't really effect me) stupid ass judge can't tell the difference between the two obviously.

I believe part of it is a generational problem. People from the older generations, i.e. baby boomers, either don't know the difference or are too stuck in their ways to change. It's possible that Apple is taking advantage of that and until the younger generations start replacing them.

Thank you Apple, I didn't really want to give another company my money anyway. It's so nice living in a world where Monopoly's run everything. Honestly though and, joking aside, I don't even have a smart phone yet. I'm not even planning on owning a tablet but this whole thing still sticks like the inside of a buffalo.

There's a rumour doing the rounds that Apple under Steve Jobs became such an efficient sales machine that they only had one Buyer, basically if you don't know (not being patronising, apologies if its coming across that way) in a company you got Salesmen and Buyers, the buyers buy the components at the cheapest cost (that's a lie, they buy them from whichever company gave them tickets for a Rihanna concert)... normally there's just as many if not more Buyers than Sales staff thanks to the complex and many more things they need to buy

Apparently Apple only has one buyer on the books.

The problem with Apple products is that they are really fucking sexy to use... for the first 10 minutes, which is enough time for a consumerist whore to get there wallet out.

I have a BlackBerry Playbook (which I call the FondleSlab[footnote]its a slab that you fondle to get it to work![/footnote] BlackPad cos I'm immature like that) and my ehPad wielding friends prefer using my Tablet and my tablet is usually the dominant gadget when using it in bars and social groups when the Internet is needed, or for the highly important tasks of putting speech bubbles on pics to make it look like your friends are saying something stupid.

Also the retina display makes files take up 4 times more space but the storage isn't 4 times the size of other tablets.

Geez. I clicked the link thinking it was over something stupid like Apple claiming ownership of the whole concept of multi-touch... again. But nope; it's even dumber. They're claiming ownership of the concept of rectangles with rounded corners. And winning.

You know what? Fuck Apple, fuck patents, fuck the whole concept of "intellectual property". I'd rather live in a world where no one can so much as claim credit for an idea than one where companies like Apple and the MAFIAA are able to hold every idea anyone has ever had hostage.

I can't believe 'they look similar' is a valid point. All tablets look similar, its their logo which sets them apart.
