Megaupload Judge Steps Down


The New Zealand judge who called the United States "the enemy" has removed himself from the Megaupload case.

New Zealand Judge David Harvey created a bit of an uproar when he told a meeting of "A Fair Deal," a group that opposes U.S. demands for changes to intellectual property laws as part of the ongoing Trans-Pacific Partnership trade pact negotiations, that those changes would have a definite and detrimental impact on the everyday lives of New Zealanders. That's the sort of pithy quote that tends to get attention, particularly when it comes from a guy playing a central role in one of the highest-profile cases of copyright infringement of all time. Harvey was presiding over the effort to extradite Megaupload founder Kim Dotcom to the U.S. and had previously come to attention in May for ordering the U.S. to delayed [http://www.escapistmagazine.com/news/view/117536-Megaupload-Wins-Evidence-Disclosure-Battle] Dotcom's extradition hearing from August until March 2013 in order to give his lawyers adequate time to prepare a defense.

"Was presiding," I say, because the controversy that blew up once his comments became widely known has forced him to remove himself from the case. Harvey's words were described by Auckland University Professor Bill Hodge was "unhelpful" but not necessarily inappropriate, but the mere appearance of impropriety was enough to cause him to step down.

"He recognizes that remarks made in the context of a paper he delivered on copyright law at a recent internet conference could reflect on his impartiality and that the appropriate response is for him to step down from the case," District Court Chief Judge Jan-Marine Doogue explained.

Despite the appearance of bias, Harvey's departure is considered a loss. "He is recognized as one of New Zealand's experts - not just as a judge but as an expert who has gone into copyright issues," Hodge said. According to the New Zealand Herald, that level of expertise made him "the perfect choice" to preside over the matter. It's also very likely a personal loss; Hodge described the Megaupload matter as Harvey's "case of a lifetime."

Hopefully the judge that takes over has he same knowledge that this man had or we'll see a very bad reversal of fortune for the case.

Folks said this was going to happen. Being a judge means keeping your emotions out of it, or at least having enough sense to pretend you don't have any emotions in the case. This judge really s'd the bed on likely the biggest case of his career all because he couldn't keep his mouth shut.

It's a shame that this happened since he is absolutely correct as the US pushes its laws on foreign nationals -- something that the US would loudly contest if it happened to one of its citizens yet something it keeps on doing. Guess we just have to hope the judge to replace him has similar feelings but more practical sense.

While it may have seem like a loss, it's probably for the best. If he remained and the trial went in Dotcom's favor then it would be easy to argue that the trial was not unbiased and deserves another trial that would only waste everyone's time and possibly lead to a ruling that isn't in Dotcom's favor. As well as a simple matter of of dealing with bias, this also means that it's less likely for the mentioned scenario to necessarily play out and may indeed be the best for Dotcom.

I'm absolutely certain there was no backroom pressure applied by the US there, none at all. Not a jot.

They don't need much of an excuse to get their way, stupid Judge giving them a good one really didn't help.

Yeah ... saw this coming. Its kind of hard to claim to be impartial with a quote like that.
Too bad though.

Hopefully whoever replaces him will continue to fight back.

We are the enemy and I hope the next judge knows that, it's not hard to see that we horribly overstepped our bounds when we took down megaupload.

He quoted someone who used that word (he didn't use it directly), and in the context it simply meant that the U.S. interests (pushing copyright laws similar to theirs), didn't meet New Zealand's interests.

This being said, he was thoughtless, and he probably should have expected this outcome.

Hopefully the U.S looses still, they deserve to be taken down a peg or two.

They need to stop trying to be the police of the world, and the rest of the world should learn to stop them.

The ideal representative of the law: The Judge, MUST REMAIN IMPARTIAL.

Impartiality to the case in hand is a must. You cannot carry out the law set up by others if you are not impartial.

This is why Elected Judges are the most fucked up ideal in the History of the Law... yes... that was directed straight at you USA...

A Judge who shows himself to not be impartial in any way shape or form must be removed.

David Harvey... you fucked up BADLY.
