well I wasn't going to get a 3DS as it is, but with that level of privacy removal I'll warn everyone else I know to stay away.

You can't beat pirates, I don't know why nintendo bothers. You have to pay people to work 8 hour+ days, pirates will bust their ass 24/7 to break their stuff FOR FUN.

After reading this thread so far, it seems that lacktheknack is perhaps the only one that is taking an objective viewpoint here. For that, I applaud him for his logical posts, though he loses a few points for coming up with imaginary statistics in his most recent one. Sorry, man.

As for my thoughts on the subject, I've never liked DRM, the thought of not really "owning" what I've purchased never sat well with me, but the only kind that I cannot tolerate is the DRM that limits activations of software installations. The kind reported by Destructoid, While shady enough to put me in a state of unease, isn't really going to affect me. I've never really seen the point in most homebrew applications on portable game system hardware as other devices are often much better at the task the software is meant to perform. While I will surely miss the option to use the device in ways which were never intended, it's main function in my life would be to play games, specifically Street Fighter and Megaman Legends 3. The tactic used by Nintendo does not inhibit me from doing so.

Good DRM is transparent to the legitimate user. This seems transparent enough.

I don't get all these people saying just don't buy it then. It's idiotic for a company to make a product that drives away it's consumers.

Hows it going to track how many steps I take in a day if its laying on my bathroom sink?Because Id only play that gimmicky over priced toy when I'm taking a dump, maybe it will keep my bowel movements on file as well.

I can sum up this whole thread with one hypothetical argument.

OP: "I just found out that the Dell and Apple are monitoring all Dell and Apple computers in America, they are checking all your emails and all of your files, all of your internet history and all of the information stored on your computer. If you try and pirate anything or use a computer for anything other than it's intended purpose, they brick your computer."

Sensible People: "Well that's just an invasion of privacy and that is illegal. This is going to seriously affect everyone, even the people who don't pirate, and it is morally questionable. They repeatedly breach our rights in the interest of 'protecting us' but it is reaching the point where it is just becoming authoritarian, if this trend keeps up everything you do will be monitored 'in the interest of your safety'."

Special People: "Well done Dell and Apple! This will really stop those pirates! I can't see how this is morally questionable at all, they are only going to monitor my time spent on canihascheesburger.com or how much time I spend playing video games, it'll only benefit me really! Please, Dell and Apple, take all of my money! Keep them nasty pirates away from me! If you don't like it, don't buy it, pirate!"

The individuals: "Don't blame me, I bought an Acer computer"

Also, food for thought: there will be an online store in which you will enter your payment details to buy games. Nintendo will be monitoring this information and storing it in their vast databanks.

Bah, if this had been about computers there'd be a dogpile of self-build enthusiasts telling everyone that you deserve that sort of shit if you buy off the shelf.

This may help combat piracy but it's technology like this that scares me. I live in fear that we're going to end up in a V for Vendetta style world where the government has absolute control and having technology that tracks every movement and action as well as games just makes it a little more real. Add onto that the enitre 'always online' feature and I end up feeling like I'm just being endlessly watched, I would end up feeling the need to put a towel over the DS just to do something private.

I like that it combats piracy, but it's just promoting my fear that little bit more.

As much as I hate to say it, it's a bigger issue than it seems.

Much like the Wii, the DS has this measure which can brick consoles with an update if 'pirating tools' are used with the console. Out of the 20+ people I know that own a Wii, the only reason they use homebrew is to edit the region settings. These are people who purchased their Wii on release, purchased a JP game that had no EU release.

Let's face it, it's not only screwing over pirates it's going to hit importers. Any 'Tales of' announced for the 3DS will undoubtedly have JP exclusive releases (damn you Bamco!). I can guarantee that it will bother pirates for about a month, if that, whilst they learn the ins and outs of the 3DS and then later crack this features like a bothersome fly. Leaving us paying customers with Nintendo leering over our shoulder like Big Brother.
