Activision and Double Fine Settle In Brutal Legend Lawsuit



The legal saga over Double Fine's Brutal Legend has come to a close, with Activision and Double Fine settling outside of court.

If you were expecting some sort of courtroom fireworks to fly in the Activision vs. Double Fine case over Brutal Legend, I'm sorry to disappoint: the two companies have reached a settlement outside of court and the long-winded legal saga full of suits, counter-suits and shrill smack-talk has finally come to an end.

No details have been released regarding what exactly the settlement consisted of, all that we have to go on is a statement from the Los Angeles Superior Court saying that the two parties had reached an agreement, as reported by The New York Times [http://www.nytimes.com/aponline/2009/08/06/arts/AP-US-Games-Brutal-Legend-Lawsuit.html?_r=2].

A hearing had been scheduled for today that would determine if the judge would rule against Activision's attempt to delay the game's release, but that's all been canceled now. A week ago that same judge had remarked that he was tentatively ruling against Activision and that he didn't see much chance for the company to win this battle. Perhaps that discouraged the mega-publisher from continuing any legal action, leading to the settlement.

Whatever happened exactly, we might never know. Regardless of that, the important thing is, of course, that the game is coming out as originally planned this October.

it's coming out in Rocktober, trust me, theres a difference.

I'm always a little disappointed when I read things like that. I wish details would be released faster if only to sate my curiosity.

I was never worried about this. EA was already way too into the hype campaign to bail on this project. Activision bid their time, waited for the right moment to strike, and probably got a nice out of court settlement from EA (who are no doubt none-too-happy.) Really though, it's EA's fault for not properly buying the publishing rights.

Interesting assumption. Here I thought it could just be that Activision saw it wasn't going to go their way, that they were going to lose out on delaying the release even before entering into a lengthy court battle, and decided to pay up and shut up.

Now let's get this party started!

I'm looking forward to Brutal Legend and I'm not even a big heavy metal fan. It looks to be one of the few orginial titles out for a long time. Rock on Double Fine (please excuse the pun).

If Double Fine/EA was going to win then why would they settle? A settle is a compromise. And we all know, when you compromise, nobody wins.

In a global recession climate I imagine a compromise is preferable to throwing money at lawyers for a ridiculously extended amount of time.

Boyah. Brutal Legend is going to be the best game of the year. I know these things. Particularly now that it's coming out when it's supposed to...(barring any delays, which seems highly improbable as they've put so much emphasis on 'Rocktober').

Okay, win, I am happy about this, me and my friends were complaining at each we are dieing to get it. (Well, I was at him, and I showed it to him and now he is complaining more then me. xD)

Is anyone else worried, after Activision's CEO's remarks about raising prices, that the company might use the loss of a promising new IP as a rationale for screwing gamers at the cash register?

Brilliant! Can't wait for this one. Possibly Activions decision could of been caused by all the ire they were getting from the community.
