It's all part of the plan...TLDR - in the US at least the FBI and congress will eventually use their power to crack down on tool and content distributers to limit the blowback once it starts affect the rich and powerful. It's not quite "out of control" as it may seem on the surface.

Like others have said, photoshop still requires a degree of skill, while AI software has a much lower barrier of entry.
Pretty much. I used to have to the paperwork for lawful intercept and copyright violations. For what its worth most MSO take the side of the user, only because of the cost and hassle. They lobbied a bill through congress maybe 10 years ago where in if you want to sue somebody for copyright you gotta sue them directly, you can't just file monetary claims against them and make MSOs contact them. That's why you heard about Nintendo suing distributors directly. Its not because they want to it's just illegal now to take them to claims or Hassle MSOs. You could say "Well I'll just spinup my own server", except they'll just ban distribution either explicitly or by having corporations remove and hide search engine results on their own, not wanting to facilitate the production of illegal content. Then they'll remove existing datasets for privacy and copyright concerns.
The fact that it's open source is just a mild inconvenience, meth is open source, so are AR and AK rifles. People will gladly accept its ban after 24/7 nonstop media attacks.
