Axl Rose's Guitar Hero 3 Lawsuit Dismissed by Judge



No more fun and games for the former lead singer of Guns N' Roses as the judge rules in Activision's favor.

Guns N' Roses former front man Axl Rose was not too happy when he saw the band's songs being used in conjunction with the likeness of former lead guitarist Slash in Guitar Hero III: Legends of Rock. It was enough for Rose to press charges against Activision, stating that the company broke a promise not to use either the band's songs or Slash's image. Superior Court Judge Charles Palmer took the case under submission on January 31st after looking into the contract claims made by the lead singer. Earlier claims of fraud and misrepresentation were thrown out last August because they were filed too late, and Activision lawyers followed up with a request to dismiss the remaining contract claims. Last Thursday, Judge Palmer agreed with the request, affirming his previous ruling and shutting down the lawsuit.

Rose's lawyer Geoffrey Neri stated during the two-hour hearing that the singer agreed to allow Activision use of the rock hit "Welcome to the Jungle" only if no images of the classic Guns N' Roses lineup or of Slash's former band Velvet Revolver were used in the game. The game ended up featuring Slash on the front cover, and Velvet Revolver songs were added to the game as DLC.

Lawyers objected on Rose's behalf as Legends of Rock was being produced; Activision, on the other hand, continued despite his complaints, Rose's court papers say.

Rose said that he never approved of Slash's image being used in the game alongside the song since it would "further perpetuate the confusion in the public mind between Slash and Guns N' Roses" [http://www.escapistmagazine.com/news/view/105598-Axl-Rose-Sues-Activision-Over-Slashs-Inclusion-in-Guitar-Hero-III ]. Slash left the group in 1996, and Rose has reputedly been on bad terms with several former band members since its collapse.

Last time I checked Axl Rose is still the lead singer of Guns n Roses...

OT: Meh, slow legal system you've got going on there. I don't really care about it but I can see where he's coming from about the confusion thing but I doubt it's really anything to do with that.

The iconic image of Guns n Roses includes Slash. If Axl Rose wants to bring the franchise in the new millenium, good luck. But he still can't revise history.

You know someone's got a bad rep when gamers take Activisions side against you. Axl's got control issues, but I find it amazing that he had the stones to keep this fight going while Chinese democracy turned out to be the music worlds Duke Nukem Forever. His old stuff is pretty much a licence to print money in games like rock band, yet he continues to hold out and force his new crap on everyone.

That man knows how to hold a grudge.

hahahahahah.... Yeah this is allll for publicity. The guy did not want to win or get anywhere with the lawsuit. How do I know? How fing hard is it to get documents submitted on time if you are really trying to win? Not very. How easy is it to file a suit so people notice you then not put all the paperwork in so it defaults. Very.

Several years after the entire world has stopped caring about that game, and Guitar Hero as a franchise... I don't even like classic GnR, and I still can't stand that man. Every time I hear about him, he's whining about something that usually has to do with Slash, or old GnR, or something equally stupid. Your years in the limelight are over, buddy. You can stop having huge, attention-grabbing hissy-fits to remind people you still exist. No one cares.

From the brief skimming of the article, it does look like Activision bent rules in their favor by using DLC, so I can understand why Axl is pissed. Beyond that, it's petty bullshit and should have been dismissed far sooner than this.

the more i read and hear about axl rose rose the more it seems like he's just a colossal dick...

My only problem with this is it sets a bad precedent for people that aren't assholes.

I respect Axl as a great rock singer. His voice is just iconic but another part of classic GnR is Slash. Surprised ANYBODY goes to see them live anymore, just doesn't seem worth it if Slash isn't there.

I find it funny that this lawsuit outlasted the guitar hero franchise. It honestly would've been hilarious if this thing ruled in favor of Axl Rose.
