Blizzard Prepares to Sue Over Illegal StarCraft TV Broadcasts



Blizzard is preparing for a significant legal battle in Korea over the television broadcasting rights for StarCraft.

StarCraft [http://www.amazon.com/Starcraft-II-Wings-Liberty-Pc/dp/B000ZKA0J6/ref=sr_1_1?ie=UTF8&qid=1291478751&sr=8-1] is so big in Korea that it's comparable to baseball, football, or soccer in other regions. The best players become big stars, and the game's tournaments are often broadcast on television. These sorts of broadcasts are a-ok with Blizzard, just as long as the television networks have its permission, which some of them recently do not. Blizzard says that it plans to take these networks to court.

Blizzard currently has an exclusive partnership with Korea's Gretech-GomTV for the broadcast and operation of StarCraft tournaments on television, which also grants GomTV the ability to negotiate television deals with other Korean networks. However, networks such as MBC Game and OnGameNet have been televising their own StarCraft tournaments, organized by the Korea e-Sports Players Association (KeSPA), which are not sanctioned by Blizzard. KeSPA claims that StarCraft is public domain.

Blizzard once had a partnership with KeSPA, but cut ties after KeSPA sold StarCraft television rights to other companies without its permission and the two couldn't negotiate a new deal. Blizzard now promises to bring MBC Game and OnGameNet to court, and is also considering litigation against KeSPA. The two networks were allowed to finish broadcasting the previous StarCraft season, but have continued to televise tournaments since then against Blizzard's wishes.

"It's unfortunate that the e-sports industry in Korea is lagging behind other industries in recognition of intellectual property (IP) rights and the basic principles related to them," Blizzard COO Paul Sams told journalists in Seoul. "Korea is the only region in the world where we have had to resort to litigation to protect our IP rights."

Blizzard believes that it deserves to collect licensing fees for televised StarCraft tournaments to both protect its rights and to give it incentive to continue to balance the game. "Classifying StarCraft and other e-sports as part of the public domain deprives developers such as Blizzard of their IP rights," Sams added. "There will be no incentive to do what Blizzard had done to balance the games for competition, which is a more difficult task than creating a normal game."

GomTV offers 12-month StarCraft television contracts for 100 million won ($86,800) per league. Sams calls MBC Game and OnGameNet "hypocrites" for complaining about this deal, which costs around 20% of what KeSPA charged when it illegally sold StarCraft's television rights. Blizzard doesn't necessarily care about profit in this case, and only wants to protect its IP just as the NFL, MLB, and other organizations vehemently do.

I was going to say surely this only hurts them but it does seem like they are basically trying make money off blizzard's IP without giving them their due. I'm betting on a settlement and maybe some contractual obligations but I can't see it turning huge without upsetting the whole enterprise and losing money for everyone involved.

So KeSPA previously bought the rights, then illegaly sold them to make more profit and now they refuse to buy them because it's 'public domain'? What idiots.

So why did they initially buy them then?

Same reason people watch football, baseball and everything else TV has to offer?

P.S. If I could have Lets Plays broadcasting on a channel, I would absolutely subscribe, provided that I buy a TV

How is watching hockey or golf any more interesting? I think SC is at least ten times more interesting than all the international sports tournaments.

Actually Starcraft is bigger than you put it. The government made the day Starcraft 2 come out an official holiday. Anyway, nice to see lawsuits over actual things rather than the stuff we have been seeing lately.

Why do people want to watch people throw/kick a ball around or watch people kick the crap out of each other? Do you watch your friends play video games? Same thing, just on a larger scale.

The only real sport I would rather watch than a well played, well commentated Stracraft 2 match is Hockey and World Cup Football. If they had a SC2 network here in America, I would watch it all the time.

Why would you want to watch poker players when you could just play poker yourself? Because they're professionals playing for big money.

Why would you want to watch Tiger Woods play golf when you could just play golf yourself? Because he's a professional player trying to win big money and can pull off amazing shots.

Why would you want to watch Amercian Football when you could play it? Because those guys are pro's, who can pull off amazing plays.

Why watch people play Starcraft? Because they're professionals, you can learn from them, you like Starcraft but dont feel like playing right now and there could be some drama and big wins going on.

OT: The KeSPA sound like a right bunch of fools to me and it's good to see Blizzard bringing like minded orgs to court.

It's nice to see that video games are phasing out traditional sports, at least in Korea. I'm with Blizzard on this one, but I hope they can come to some agreement. I would have thought that video games would kill traditional sports spectating outright, but this is a step in the right direction.

I spent a month in china and from what I could gather they even export SC broadcasting. it is REALLY their de facto national sport.
