The scope of the definition and penalties for piracy are too broad.
Seeking legal action against for profit pirates...fine enough.
Stopping obviously pirated software at the boarder...sure go for it.

However, making mod chips illegal and trying to go after individual pirates?
No, bad idea. Mod chips themselves aren't always used for copyrighted material.
Sometimes it's just used in order to play games from different regions.
In order to go after pirates effectively would require some very invasive policies and law enforcement actions.

Jailing pirates seems to be another bad idea.
That doesn't help mend loses caused by the piracy, it just places another burden on the taxpayers.

This isn't the final product of these newer anti-copyright laws, it most likely will not even get passed.
Even if a similar law does it will probably be changed and refined several times.
So, I'm not overly worried.

Kwil I still have a working VCR, that I use. (Not nearly as often as my DVD player though.)

Problem is, they'd have to make some insane changed to even be able to find these people. You'd have to warrant searches on people's computers randomly and enforce security routines that the public would severely frown upon.

The price of security is your own happiness (bulletproof armor in a gunfight not withstanding).

I very strongly oppose the ban on mod chips.

There is absolutely nothing illegal about modding a console.

As a computer science undergrad, I enjoy having the ability to write simple games for Wii; it's very satisfying to use the Wii's developer tools to make something really cool.

If mod chips become illegal, you'll need a license to make even homebrew software.
