I'm going to go out on a limb but I'm assuming that there is alot of bias on this site regarding this subject...Still, bureaucrats don't take no shit, liberal or conservative so this trial might be biased per se although it is an interesting subject on how sexuality/porn is considered more as a taboo than violence.

Even so, why did he think this might not be an issue? Social or legal. We all have our perversions that may raise questions but most of us do not act it out or express them...Or at least with other people.

I can't believe his own wife called the police on him. Kind of sad he's going to go to jail for not committing any real crime. More than likely, just a well adjusted person who had the self-control, and knew sexually abusing a real child is wrong as not to act on his brain's innate thoughts. So he looked at fictional pictures to satisfy his brain's natural fantasies that comes from a healthy curious brain.

Yet another case of law enforcement and the criminal justice system in this country avoiding real work because arresting and convicting actual criminals is dangerous...

What exactly is the difference between this and Nabakov's Lolita? Both are depictions of underage sexual activity - one visual, the other verbal. People are capable of getting turned on by either, and (in theory) being influenced to commit child abuse, which is what the laws were designed to prevent. Maybe the important thing is comics and cartoons are not recognized as art. By police, judges and legislators anyway.

Well, a key point of US obscenity laws is the claim that porn possesses no merits whatsoever and thus doesn't count as speech. So if you take those porn pics and write something like "American foreign policy" under it that should be able to give a court a headache. Even the "no porn to minors" law is justified with that kind of "enemy combatant" style newspeak so porn that doubles as political caricature could be legally sold to minors because of the First Amendment (don't like it? Don't write laws like that into your constitution!).

You can't "cure" pedophilia any more than you can "cure" homosexuality (other than by chemical castration, I guess). One is worse than the other for obvious reasons, but this sentence is nothing but condemning thought crimes. It's also bringing to daylight something that society as a whole will never accept in his lifetime, something that was nobody's business but his. The only victim in this crime is him (assuming of course that he hasn't ever escalated from just fantasizing). But this has all been said before.

I can understand the wife ratting him out, however. Finding porn (cartoon or not) featuring minors and incest on your husband's HDD has to be a shocker, especially if you have/are planning to have children yourself. How would you deal with that? Would you buy the excuse that it's just something he's into, that he'd never do it for real?

Another reminder that we live on a planet full of idiots who live their lives without ever really thinking about anything they do. I sure needed one of those.

(Not you guys, you guys are great)

I'm guessing even with a jury his chances aren't very good. There's nothing wrong in masturbating to drawings - no matter what they are. This law is outdated and harmful.

Also, that's one disgusting wife.
unless he was leaving it out in the open then she would probably have had to dig deep to find it, almost like she wanted an excuse to get away from him

A smart man knows how to hide his stash, a smarter man adds a lock and key, but a suspicious woman will flip the earth on its side in order to quell her curiosity or remove undesirable things no matter how small it may be.

This is just a disgusting case of authority abuse from focus groups and the fact he's prosecuted over a fictional drawing now opens up a can of worms. It's the start of a slippery slope of if this cartoon/drawing etc. of a fictitious event is considered harmful where will the ball stop rolling, will those who downloaded the child killing mod for skyrim be prosecuted for acts of violence upon a minor because these self rightous groups cannot distinguish between fiction and reality? how about gta with killing the hooker thats clearly abuse against women. where will it end? maybe x-com when killing infested civilians after all your soldiers are killing an unarmed civilian (ignore the fact that an egg has been implanted in them and they're dead anyway). This list could just keep going on and on.
No, just no. This is a nine year old law and its not the first time it has been used to convict convict somebody who had cartoon child pornography. There are also similar laws in many other countries that have also been used for years to do this. Also there have been a large number of cases where somebody was investigated because of cartoon child pornography only for police to find real child pornography on their computer as well.

The fact of the matter is unless you are a pedophile you dont need pictures of naked five year old girls on your computer drawn or not.
What exactly might I ask, is your problem with pedophiles? Isn't it just another fetish? Everyone has their kinks, this is his. As long as no one is hurt whats the problem?

We must protect the children and get rid of all these normal people with fetishes errrr horrible pedophiles!!!

How dare people have Rule 34 cartoon porn incest of The Simpsons, Family Guy, South Park, The Incredibles etc... on their computer!!!

We must lock all these people in federal prisons so they can work for the government for free by giving their free labor!

>_>
/sarcasm

In all seriousness I think Virtual CP (using real children images to create CGI CP) and Real CP should be illegal.

BUT lolicon, shotacon, and cartoon pornography should NOT be ILLEGAL.

^^^^ Like I said in my last post.
do you really think people that look at cartoon incest porn like maybe a Rule 34 of the Simpsons family or Family Guy, South Park, The Incredibles etc. need to get put into prison for 3 years and have a pedophile record for the rest of their life?

I'm sure most of you guys have seen a rule 34 like one of the ones I mentioned above or even maybe have a few saved on your pc for lols or posting on 4chan.

Either way if this stuff is sooo dangerous and illegal then I don't want to live on this planet anymore.

Going to freeze myself, wake me up when we all become reasonable intelligent beings.

Last time I checked, virtual child pornography was exempt. I guess that's changed in last few years.

Also, why the fuck is this on the Escapist? No, serious. What in the heck does this have to do with gaming in any way shape or form? Does the Escapist just publish any story it feels like rather then one that fits it's website's theme? Why is this here?

Also, a laugh at all the people who are all riled up because 'nobody got hurt!' and 'he can do what he wants!'. It sounds if you completely fail to get the other side of the argument, and that's a far worse crime then what this guy did.

It might just be that people around here don't like the idea of being punished for child abuse, when the child in question doesn't exist.

As far as I know he was charged with Obscenity charges and the Miller Test was involved. Child Porn is a different category of laws. This guy got screwed, you can own obscenity, you just can't promote or distribute it.

I don't want to get the other side of the argument because the other side of the argument advocates thought crimes and throwin people in jail based off the possibility that they might one day do somethin.

People who have that kind of mindset, where if somethin is icky and gross it should be wiped off the face of the earth, those kind of people sicken me far more than a pedophile who hasn't actually done anythin.

Really? I'm surprised to hear that they've removed all police from the beat so as to better pursue pedophiles. Cops go out and risk their lives every day, and it grinds me gears to hear people complain about cops not chasing "real criminals", as though cops have switched to exclusively handing out speeding tickets or whatever. They can do both.

So the dude is a pedo? Since i'm a guy who thinks every pedo should be rounded up and executed (possibly via carnival shooting gallery of sorts), I can't say I care. Hopefully this takes some heat off of a couple people in this thread.
I appreciate that you want to protect our children and I'm sure most the people in this thread would agree with such a noble goal, but pre-emptive execution is not the way to do that. All that'll do is drive people attracted to children who haven't broken the law yet underground and make them avoid getting the psychiatric help they may need to keep themselves from harming children, after-all who would go to a psychologist if it could end up a fast track to one's death?

This absence of support could only lead to more children being irreversibly harmed and so us defeating the aim we originally wanted to achieve, reducing the abuse of children.

This just further justifies destroying my PC whenever a police officer gets within twenty feet of the front door.
I know someone who has a thermite bomb permanently on top of their hard drive.
In the event of a raid, all he needs to do is light the thermite, and bye-bye data!
Damn that's awesome I should look into that. I was thinking of just yanking out my hard drive, smashing it into tiny bits and flushing it down a toilet. Thermite though... that would be glorious.
Your avatar makes that statement all the more hillarious....

On Topic: ...Eeehhhhh....Whatever...it's just one dude...I'm not too irritated by this. I do think it's stupid cause it's...a drawing, Although I personally dont like that so...Kinda happy he got into trouble, but this might be too much.
