Nintendo's not psychic, and it can't tell which ones are going to go the distance, and you can't ask them to monitor the entire internet looking for fan projects.
If they're really serious about protecting their IP, isn't monitoring for fan projects exactly what they should do? Even if they don't think plans for a Pokemon MMO 9000 will come to fruition, if they really have a problem with the possibility of the end product "diminishing the dignity or value" of their property, the least they could do is send the dev's an e-mail saying, "Knock it off."
And then they would turn into even bigger dicks. It's a lose-lose situation. If Nintendo cracks down on everyone, they'll look like assholes who hate their fans. If they only crack down on the ones that look like they'll be released, they look like assholes for ruining people's hard work. If they don't crack down at all, then their IP becomes unenforceable.

Either way, Nintendo loses. They just went with the least-painful option. 1 PR disaster is preferable to 1000.

Being free of charge means jack shit to anything about them making money off making it. Movie Makers CHARGE to get their movies into the theaters or did you not know that tid-bit of information. Also just because your open about a project doesn't mean that they take you seriously.
Movie theaters, particularly smaller ones, often have free events. Considering this was a fan made movie and not taken seriously enough to even be released on DVD, it was more than likely one of those free events.

or did you not know that tid-bit of information?

Oh right, Nintendo just HATES killing fan projects, that's why they wait until THE DAY A YEARS-IN-THE-MAKING PROJECT IS COMPLETED TO TELL THEM THEY'RE SHUTTING IT DOWN!

Actually, that's how most companies do it. See, little fan projects like that tend to get started very frequently (many of which I'm sure no one hears about). More often than not, the creators of the project will get bored or hit some other obstacle, and it'll fizzle-out on its own. Thus, it isn't really worth a companies time and effort to take legal action against a project unless it's far-enough along that it's more likely to see completion. This is why projects being shut-down due to legal threats are always cases of "it was almost done".

You don't want to?

THEN STOP DOING IT.
It's called profits. You know... the reason Nintendo is in business in the first place. When you start a project that can cut into them (like, for example, an MMO-version of a game being offered for free that can take away sales of their trademarked game), then they really don't have a lot of choice but to shut down the project, even if it's one they wish they could have left alone. It's not to say that the Pokemon MMO would have run Nintendo out of business, but taking money out of their pockets is taking money out of their pockets. I didn't go bankrupt when someone stole my GBA years ago, but that doesn't mean the thief was any-more in the right for doing it.
It's one thing to do it, it's another to do it, and then make a PR statement saying "we don't like to do it, and often don't"

Even during FREE events the movie maker MAKES money from the Cinema.

Also didn't you read the article that says that Nintendo is VERY protective of their IPs when it comes to movies?

So as long as whatever you're doing doesn't "diminish the dignity or value" of Nintendo's properties, it looks like you're good to go, Mario and Zelda fans.
No, I didn't read that article, I read this one, the one that says they don't like to shut down fan projects.

Just because the movie was Fan Made does not mean it was GOOD. Nintendo also doesn't say that they don't shut down fan projects just that they don't LIKE to. Shutting the movie down after it was completed was probably something necessary for them to do.

Nobody said it was good, but if Nintendo is going to shut down a fan project years in the making when they really didn't need to, they then shouldn't announce that they "don't like doing it" as if we're supposed to feel bad for them or some shit.
