Notch Challenges Bethesda to Lawsuit Deathmatch

Before this all thing, I loved Bethesda for the TES and fallout series, while I wasn't too keen on Notch, following the whole dogs buisnees and all, but NOW...
Wow...just wow.
Keep strong Notch. Fight the good fight.

Well, as a cool and smarty pants PR move to rally gamers to him, Notch gets my applause.

You all, however, keep forgetting that all of this started because Notch tried to trademark the word Scrolls. Not "The Elder Scrolls", like Bethesda has. No. Just "Scrolls". Notch is playing the part of Tim Langdell and Bethesda the role of EA and DICE in this new season of trademark nonsense. Sued by Bethesda or not, Notch is a real troll for trying to trademark the word scrolls in the first place. This move only gives him enough coolness to go back to the neutral state after the dickish attempt to trademark a noun.

Remember, Notch tried to trademark the noun scrolls. How about you guys step back and think about why you are defending this in the first place and reign back the hypocrisy?

Because there has never been a video game with a single-word title before.

The thing is... Both Bethesda and Mojang are game companies. Their target market are gamers.
If they accept this insane proposition, they will both gain immense publicity, which is good. Even if one of them loses, they are still going to have the respect of all gamers. It's a win-win scenario.

On another note though - you do realise Bethesda will win, right?
They have motherfucking ID Software in their corner - no way will the guys 'n gals from ID let a company in the same stable as them lose at a game that they designed, in a genre that they created. No way.
Unless, of course, the Mojang people have been secretly practicing for years in their Scandinavian ice fortresses...

Umm...what? There are plenty of games with single-word titles throughout the years. A lot of them were common nouns too. Your statement is not only wrong, it's not even a valid argument. What does it matter if there has or hasn't been a game with a single-word title before? No company (indie or whatever) should be able to trademark a common noun for their exclusive use. A phrase, like "the elder scrolls" is now a specific combination of words that has quite a bigger argument to be able to trademark.

Just for the record, I do not side by companies bullying with power. Bethesda shouldn't be able to bully Mojang because "scrolls" is just a part of the name they trademarked, not the entirety of it. However, Mojang should not have to right to trademark scrolls just as Tim Langdell shouldn't have had the right to trademark edge. People bash him rightly so, but then turn around and applaud Notch when he is proceeding in the same manner (most likely without the same intent of lawsuit trolling, but that's another matter).

I'm thinking Beth is actually preemptively on the defense here. They aren't suing so much because "Scrolls" infringes on the trademark "The Elder Scrolls" as much as their trademark being undermined if Notch manages to legitimately trademark the word "Scrolls", and from that position, potentially sue Bethesda for having its flagship franchise bearing a strong resemblance to the Mojang game "Scrolls"... and Mojang theoretically could potentially get a lot of legal leverage for such a dick move.

I think Beth should decline this challenge... Instead, Todd Howard should challenge Notch to MORTAL KOMBAT! (The 1992 game)

However, there does need to be a way for Notch and his studio to trademark the name "Scrolls" to protect his own creation, but a limitation to keep it from extending to other common trademarks. And, it's not a dick move to trademark the name of a common word or two. "Space Marine" is a trademark held by Games Workshop.

From the very depths of my soul, I WANT THIS TO HAPPEN. I don't care if it's lame. I want this to be the way this legal battle is solved because it shouldn't be happening in the first place. It's a little silly, and I think most people agree. I hope they show they have a sense of humor and restore my faith (or ability to believe in people being light-hearted at least) in humanity.
