PlayStation Network Post-Hack Lawsuit Gets Thrown Out



Judge Battaglia found that, since PSN users got their service free of charge, their claim to have suffered loss should be dismissed.

Last year the PlayStation Network vanished for more than a month, thanks to class action lawsuit [http://www.escapistmagazine.com/news/view/110898-Sony-Admits-It-May-Never-Know-What-Happened-in-PSN-Attack]. The suit has run aground in California and, though the plaintiffs may try to carry on, most of its claims - including negligence and unjust enrichment - have been thrown out.

The big issue, according to Judge Battaglia who presided over the case, was that the plaintiffs had failed to establish loss of money or property. None of the plaintiffs could plausibly argue that their consoles were damaged, or that they valued their consoles less; they couldn't even claim that they played them less often after the breach than they had before. Moreover, they received PSN services free of cost, and so couldn't claim to have lost money.

The Judge also failed to be convinced by the plaintiffs' argument that Sony had been deceitful, in their representations to customers, about the quality of its network security. Judge Battaglia ruled that Sony's Privacy Policy statement - "there is no such thing as perfect security ... we cannot ensure or warrant the security of any information transmitted to us" - was sufficient that no reasonable customer would have been deceived.

Plaintiffs have until November 9th to file amended complaints but, as it stands at the moment, most of their claims have been struck down or dismissed. A full transcript of the judgment can be found here. [http://www.courthousenews.com/2012/10/19/playstation.pdf]

good sony did all they reasonably could when the incident happened, give us free stuff, gave us free life alert for a year, greedy aholes suing because they could and wanted moar money.

This saga of the PSN in the end makes some of the customers look like dick in the grand scale. Sure people are going to go, "rah, rah, Sony is a corporation and therefore evil", but considering this hacking indecent came not weeks after those same people got hacked, as they were championing some hacker for "standing up to Sony."

OT: Good, honestly it wasn't Sony's fault and shit happens. Personally I have a bigger issue with the SCEE Store team these days. Still no CS:GO for us. Symphony of the Night was finally gonna get a release but now it's mysteriously vanished from the records, etc.

Did they ever advertise that the Other OS was there? I still have the box my ps3 came in and it doesn't mention that feature anywhere.

*I got my PS3 near release, long before they removed the feature.

If something actually had happened to those who had a credit card linked to their account they would have all the right to sue.

As easy as it is to blame Sony for the whole thing they actually handled it rather well.
Yes they cracked a bit under the pressure initially but they got their shit together, they tried to compensate their customers and they tried to make sure any stolen credit info was recovered.

Never on the box or any television ads, but at the very least in press releases, and I think in the e3 before its launch. At any rate, it was a selling point and the second biggest reason I got it instead of a 360 back in 2008 (the first being MGS4).

Ah, all right then. Usually when I hear people say that they advertised it I assume they meant on tv or the box itself. I never payed attention to the press releases because my purchase was based on brand loyalty raised from the PS1 and PS2.

Yeah i wonder why they removed that...o yeah, because of hackers, who openly announced that they want to hack the system through that.
