Sierra Fan Site Bounces Back From Activision's Cease-and-Desist


Sarien.net [http://www.sarien.net], the Sierra fan site that was taken down last week thanks to Activision, is back in business with big plans for the future - thanks to Activision.

After flying under the radar for close to two years with buggy but functional versions of felt the sting [http://www.amazon.com/gp/product/B000AYH89M/ref=s9_simh_gw_p63_d3_i2?pf_rd_m=ATVPDKIKX0DER&pf_rd_s=center-2&pf_rd_r=1JX5DMQE8C55WRC5Q0XA&pf_rd_t=101&pf_rd_p=470938631&pf_rd_i=507846] of Activision's legal department last week. The publisher claimed that although it "appreciates the dedication" of site founder Martin Kool, it was nonetheless obligated to issue a cease-and-desist to the unauthorized development and distribution of the games.

Kool, for his part, was cool; in fact, as he explained in a detailed history of Sarien.net on his blog [http://www.martinkool.com/2011/01/sariennet-full-story.html], Activision's response was almost a relief. "In a way, running Sarien like this - and I'm referring to its legal status - has always been a thorn in my eye. A sort of necessary evil," he said. "So, the Cease and Desist would finally put that to rest, officially, and give me time to move on." The only thing surprising about the letter, he added, was how long it took Activison to get around to sending it.

But that wasn't the end of the story. He asked Activision about the possibility of continuing the site in some other capacity and received a rather surprising response. "The next day I received a kind reply from Activision's law firm, and I actually do mean 'kind,' as I found the original C&D letter to be quite a friendly letter of which I understood and agreed to everything therein," Kool continued. "This new letter I received contained a proposal."

The proposal from Activision gives Kool official authorization to publish the first game in any Sierra adventure series on Sarien.net, along with links to CodeMasters [http://store.steampowered.com]; Activision said it couldn't tell Kool what to do with that franchise, but given all that's happened he's decided not to go ahead with the game until he gets an official green light.

"I have several plans for Sarien but first I'll restore it to what is was and provide the games as agreed upon with Activision. A redesign is scheduled, and new functionality will be added that I blogged about before," Kool said. "I see a lot of cool things happening to Sarien.net, my company and myself in the future. Stuff that involves HTML5, Apple, retro games and publishing. 2011 will be a great year."

This gives me hope for the future of publishers, awesome job!

It appears Kotick has slipped away from the public eye and there's been some things going on behind the scenes to improve their image.

Sierra games are awesome.

Great business strategy. Shut a site down that they have every right to without being docks about it, then turn around and give the site a way to operate legally and promote more sales for Activision. I'm starting to rethink my Activision boycott in the wake of some sensible business decisions...

These old Sierra games are what made me love sprites. Being able to duplicate them so easily in the cheesy pre-MS-Paint version of drawing available to me at the time and rig scenes to my choosing (and limited artistic talent for my age).

That is surprisingly awesome. I cannot figure out if the world is ending or if activision might actually not be all bad. Still in boycott mode but this makes it so much harder to hate activision if they keep this up I will have to go buy that backlog of games that I have been wanting but unable to buy due to the evils.

Did I read this correctly? Was Activision nice? This is pretty awesome. The fact that he can publish the first Space Quest, Police Quest, King's Quest and so on is a good compromise, and maybe if successfully they will grant him the rights to additional games.

While I'm in the camp of Bobby Kotick being a smug asshole that has limited business sense, this move is hardly surprising and is too small for Kotick to have his hand in it.

The trend that Kool was on, appeared to have financial reward or at least having serious copyright infringement and Activision did the necessary thing in ordering a cease and desist. The reinstatement was only after giving a clear guideline to what could be done, which is entirely understandable.

The legal fees pale in comparison to free advertisement and possible future compensation due to this move. It's not about being "nice", it's more about running a sound business. Although Kotick appears to make moves to just be a jerk, businesses (including Activision) can't actually run like that.
