If we're going to stick to morality, and not the arbitrary legal standard being applied here, the analogy of the library becomes even more powerful. If a person wants to read a book they intend to plunk down $60 for later, and they check it out from the library, is that then an immoral act? How can you attack the one act, but defend the other?
Again, because the library is created with the intent of allowing people to read for free. Authors are perfectly aware that their books are being included in libraries. You don't see authors begging people not to go to the library, cursing the existence of a library, or taking active measures to prevent their books from being readable in a library. The same cannot be said for pirating games.

I think at this point EA should be more concerned with screening its employees before it hires them.
