Have a check towards the back of the manual, the the standard warranty on a new game is 90 days. I'd suggest popping it back to wherever you got it with your proof of purchase and ask for an exchange. You're not trying to get your money back, you're just looking for a copy that works and they should be fairly happy to oblige you.
