I think its an industry standard that is self imposed, which is why it was a comsumer right's problem, instead of an animal rights issue. Not that it wasn't both beforehand, just one more than the other.

They are just attention seekers who want there own thing and dont give a crap about anyone else. Hell I think some guy was mauled by a bear and PETA came out and said he shouldnt have provoked the bear.

I don't really have any time for PETA at all, they're idiots. However, it's not really hypocrisy in this case. Ultimately, various animal protection laws compel organisations to humanely kill animals in many circumstances, whether they like it or not. Plenty of animal sanctuaries and homes ending up doing the same, having to put down many.

You could certainly say that a 95% failure rate to find homes makes it very dubious whether they should be bothering to "rescue" so many in the first place.
