Zynga Sued Over Facebook Leak


Right on schedule, Zynga [http://www.zynga.com] has been hit with a class action lawsuit over the leak of Facebook user data that came to light earlier this week.

I think it's safe to say that we all saw this one coming. On Monday, the Wall Street Journal revealed that numerous popular FarmVille [http://www.facebook.com], had been sending identifiable user ID numbers to outside companies. Facebook claimed the breach was unintentional and the information was all publicly available anyway, but nonetheless it suspended several apps until the problem could be addressed. FarmVille was not among that number, although Zynga pledged to work with Facebook to "refine how web technologies work to keep people in control of their information."

Now it's Wednesday, and the inevitable lawsuits have begun. In the first, Nancy Graf of St. Paul, Minnesota, alleges that Zynga shared the data of its 218 million users with advertisers and data trackers "in violation of federal law and Zynga's contract with Facebook." And now she wants some money.

"This appears to be another example of an online company failing the American public with empty promises to respect individual privacy rights," Michael Aschenbrener, a co-lead attorney on the suit, said in a statement. Fellow co-lead attorney Kassra Nassiri added, "Companies large and small need to learn to follow through on their privacy promises or risk having consumers decide that it is simply not worth it to use their services."

And, of course, that they want money. The class action suit seeks "monetary relief for those whose data was wrongly shared, and injunctive relief to prevent continued privacy abuses."

I'm really not sure what to make of this one. I think we can all agree that once in awhile the whip has to crack, but is this leak really worth a lawsuit? As someone noted in an earlier thread, the user ID numbers being transmitted, such as 1296236781 [http://www.facebook.com/profile.php?id=1296236781], can all be accessed by anyone who cares to look for them. There's also the very obvious question of, "Why Zynga?" It was far from the only app maker involved in the leak, yet the lawsuit drives straight for it. Would we be seeing this kind of multi-law-firm response to a less-famous (and less cashed-up) game maker?

Zynga responded to the lawsuit with a statement saying, "We believe that the complaint is without merit and we intend to defend against it vigorously."

"Why Zynga"? Zynga is the biggest, thus if they are successful, the winnings will probably be higher. Plus, it'll please most of the Escapist forums.

Yes its a small line but they were told not to cross it and they did. Give them a slap on the nose(this lawsuit is not going to hurt zynga) so they don't leek something important like someones credit info.

I really couldn't care less about what Zynga are being sued for. The fact that they're being sued just makes me feel a little happier on the inside.

Zynga deserves to be brought down a peg, for their lack of ethics (which this might be an example of) if nothing else.

However, I don't see how these people could possibly be compensated; can you put a definitive price on illegally obtained personal data? That seems like a black market commodity to me.

Finally, it's the Lawyer/Firm leading the prosecution that stands to gain the most, by far.

No matter how this turns out, I can only see this being some form of Twisted Justice, at best.

Now I hate Zynga as much as anyone. I'm also of the belief that the sooner Marc Pincus, head of Zynga, catches a painful bout of incurable ass cancer the better.

However, even hating Zynga like I do, I still am totally floored that anyone who signs up on a website dedicated to sharing personal information can act the least bit surprised when someone they don't want having that information gets a hold of it. Seriously?

Here's a free tip to the entire Facebook using public. If you don't want your personal business or information out floating in the wind then don't put it on the internet or maybe just don't put it on sites dedicated to sharing personal information. This isn't rocket science people.

im dead serious, if i knew where Zynga and the guys behind World of Lordcraft and Evony were based at, i´d become a suicide bomber.

Zynga has hidden loads of malware in their games, spams you every living moment your on Facebook, and apparently fucks with peoples personal information. they need to be destroyed.

I'm not saying that ALL Facebook users are retards (though, I'm not too far off), I'm simply pointing out the asinine nature of people who are really going to try to get MONEY from this whole thing. No one pays for it. No credit card, Social Security or any other manner of "sensitive material" should even be on the site. This is, of course, assuming that the average person possesses even a modicum of common sense. That said, don't you find it ridiculous that these "digital profiteers" are trying to get something for nothing?

I can't believe the situation has arisen where I actually want Zynga to win. I dislike them with a passion for a myriad of reasons, all of which pale in comparison to the loathing I feel towards sue-happy nutbags.

yay for another David versus Goliath case!

Y go after Zynga? cause they are known to have lots of $$. If they even have any doubt that what had happen was indeed wrong, they are gonna settle with a nice chunk of change! or the ppl suing will get smashed by the Litigation Hammer [http://www.escapistmagazine.com/articles/view/columns/experienced-points/7951-Experienced-Points-The-Litigation-Hammer] XD

So... data and ID numbers that are readily accessable anyway... is worth a lawsuit. Um... yeah. I don't see this working out quite how they want it to.

Way to blow that out of proportion. I was calling you out on being over-reactive. And you over reacted to it. The fact you even decided to call most facebook users retards over this thing shows you're overly hostile to it, which I don't understand shows that.

Yes of course I think its stupid. Suing normally is stupid, but I don't give a damn about that, I was just pointing out you were being overly prickish about something. I'm a asshole, 'tis what I do.
