Tim Langdell Files Trademark Complaint Against Killer Edge Racing


In spite of his recent setbacks, Killer Edge Racing [http://www.edgegames.com/].

Tim Langdell's name should be familiar enough by now: His ill-advised adventure against EA's [http://www.mobigame.net/] legal department waded into the fray and Edge Games, by all appearances, was a spent force, its days of threatening Edge-related litigation finally brought to a close.

But that final assessment may have been premature. Langdell recently submitted a complaint to Apple over PuzzleKing's Killer Edge Racing, which responded by asking the developer to remove the game from the App Store until the matter is resolved. Making matters worse, Edge Games has also reportedly submitted trademark filings for "Killer Edge Racing" and "Killer Edge Racers" in the U.S.

In response, Killer Edge Racing creator Nalim Sharma has hired Sheridans [http://www.sheridans.co.uk/home/home.asp], the same legal firm that assisted Mobigame in its Edge dispute. The firm says Langdell's trademark claims are unenforceable for several reasons, including the fact that they are "liable to be revoked on the grounds of non-use for five years."

"In this case and the Mobigame case we consider that under trade mark law it is necessary for Langdell [or his companies] to show that the public will be confused into believing there is an economic connection between his marks and the names used the games in question," Sheridans' Alex Chapman told GamesIndustry [http://www.gamesindustry.biz/articles/langdell-finds-new-trade-mark-target]. "There is clearly, in our view, no prospect of this being the case in respect of Killer Edge Racing or Edge by Mobigame - and that is before you go on to consider whether Langdell's [or his company's marks are even valid]."

"Additionally we have learned that Langdell is behind an application to register a U.S. trademark for 'Killer Edge Racing' despite the fact that this mark has been used freely by Nalin for five years," added Alex Tutty, also of Sheridans.

Sharma himself also disputed several of Langdell's claims, including that Edge Games had written to him "several times" regarding the potential infringement. "In fact they wrote only once, which I decided to ignore after coming to the conclusion that TL [Tim Langdell] is not capable of acting in a reasonable way," he said.

I'm glad someone gets it. God I wish Langdell would just shut up. I wonder if he realises how much of a tosspot he's making himself look like?

Looks like a mediocre game, I hope they are not courting the "Edge" contoversy to get some free press. We all like a good drama now and then, but I would be just as happy never to see the name "Tim Langdell" again. Hopefully the copy right for the word "Edge" gets revoked and people can go back to developing games instead of hiring lawyers.

Where does he get the money to file all these lawsuits?

You'd think after the second or third his bank manager would be refusing the funds for all the expensive lawyers, or is he the kind of nutter that self represents in court?

Obviously, the clear solution to this is to put the word edge into the title for Call of Duty: Modern Warfare 2. I'd like to see him sue that.

wow this guy just dosent know when to quit i would have thought the embarresment of defeat over the first edge infringement would have shut him up but apparently not. Shame on you Tim, but hey chances are its not going to get him anywhere except look like more of an ideot.

OT: You know, if he keeps on doing this, the word "edge" will be outlawed. No one will be happy then. He may as well go on ahead and try to complain about every other instance of the word "edge" in gaming, including a little known Fire Emblem weapon known as the "Killer Edge", for example. He will fail, and we will be there to see it. Of course, he's failed before, but he surely seems adamant about this.

I wonder if he is next going to hunt down the racer edge for example. Which is a snowmobile shop in Calgary that was started in 1988. There are a tonne of other places that also use similar wording that have been around a lot longer than this whole edge thing.

I could understand him going after a game simply called 'Edge', even if it is being rather padantic but this seems just to be over the top, is this word to be forbidden in any form in gaming?
