360: Swapping HDs in a Modded System?

A friend brought over his modded Xbox 360 last night and decided to leave it here "for a few days". He has a couple of burned games that I intend on buying for my non-modded 360 later on, like Smackdown vs Raw 2010, and I was thinking "Gee, I'd really like to hang on to my create-a-wrestler files".

So, the question here is, "Can I put the HD from my non-modded 360 into the modded one, play, and return it to my console without getting locked out from Xbox Live"?

I'd just assume that you will get caught and banned and not do it, especially as it appears to be Banhammer Season [http://forums.xbox.com/1386/ShowForum.aspx] for the X-Box Live Policy Enforcement Team and people are being banned left right and centre for similar and a whole manner of other infractions.

You shouldn't expect to get much help from these forums, as what you're essentially asking for is help with committing an act of video game piracy and not getting caught for it.
