TV Channel Pulls Ad It Plagiarized From Sony


A New Zealand TV station that ripped off a North American Sony advertisement has pulled the commercial after being highlighted by the Internet Spotlight of Shame.

Imitation has been called the sincerest form of flattery, but it seems that some people just aren't taught the difference between "imitation" and "plagiarism" these days. A TV network in New Zealand seems to have trouble with this concept and has pulled an ad for its services after it was revealed that it was a shameless rip-off of a Sony ad aired here in the United States.

TV3 in New Zealand blatantly copied <a href=http://www.youtube.com/watch?v=aZhPK7IR-qU&feature=player_embedded>Sony's "Montage" commercial, recreating it with practically identical dialogue and even stealing the 80s rock-out ending. It's pretty shameless and more than a little stunning that someone managed to get this filmed, edited, and aired without someone from TV3's legal team smacking them upside the head.

After various sites <a href=http://www.escapistmagazine.com/news/view/102230-New-Zealand-Commercial-Mimics-Kevin-Butler-Ad>highlighted the similarities between the commercials, the network has since confirmed that it's pulled the advertisement. Shortly before the ad was pulled, though, "Kevin Butler" issued a response to the commercial <a href=http://twitter.com/thekevinbutler>via Twitter: "Dear TV3: You could have at least put my photo on top of the amp."

Overall, Sony actually seems to be taking the whole situation in pretty good humor. On the PlayStation Blog, Kevin Butler wrote a fairly forgiving post about the offending ad: "It's clear to me that TV3 appreciates great advertising and I'd like to thank them for their efforts. In fact we'd like to help them out and make our ENTIRE LIBRARY OF COMMERCIALS available for them to copy in order to promote their programming. I only ask that TV3 doesn't use our actual footage, but all future homages of this sort are now Kevin Butler sanctioned."

While the Kevin Butler ads don't air in New Zealand, it's not like these videos have been difficult to find on the internet. They're generally pretty funny and get a lot of attention. A google search for "Two words. Mon. Tage." reveals the PS3 ads right at the top of the page. You can almost be certain that someone in the marketing department at TV3 is getting fired for this.

The thing I hate about this the most is them claiming Montage is two words, its one.

Everyone knew this was going to happen.

Its nice they like the Kevin Butler ads so much. And honestly, who doesn't. But still, copying the commercial down to the details is just stupid.

I wonder how they couldn't really have found it out sooner?

Only Kevin Butler is allowed to split "montage" into two words. Justice has been served.

Although I'm glad Sony had a sense of humor about all this.

Its not even that great of a commercial. I mean if you're going to blatantly plagiarize something at least make it something worth while

Well there's a few things to mention... For one thing, no one in NZ (and I mean like, the general population, not uber-nerds) knows who Kevin Butler is, or that he makes commercials. Secondly, none of those commercials are ever screened in NZ. And third... We don't take commercials nearly as seriously as Americans seem to, so this fact, in conjunction with how hard it is to get fired in NZ anyway, would lead me to the conclusion that the guys job is probably pretty safe.

And another thing! After going out and finding out who Kevin Butler is - they're advertising different products to different markets... This isn't like an academic doctorate or anything... the plagiarism is hardly important, and certainly isn't going to cost Sony any money.

Which is a shame, because if I was paying a guy to come up with interesting, effective and unique ideas for advertising I'd hope his research involved more than scanning youtube for likely stuff he could blatantly and unashamedly steal.

Ok, maybe he shouldn't get fired, but I'd expect more than a poor knock off of an otherwise average advert.

I liked the TV3 commercial almost as much as the Kevin Butler commercial. Almost. It takes something special to one-up Kevin Butler. Quick question: is he ever going to do movies? C'mon, you know you'd love to see "and Kevin Butler as the CEO" on a movie poster.

Why should someone get fired over this? It's not unethical, and it's not illegal either since the copyright holder gets to decide what counts as infringement and what doesn't and in this case Sony has decided that it isn't infringement.

Haha our entire country has like half the population of New York City. We only have 4 State Broadcasters. Tv 1, 2 and 3 ... And then C4, which I'm guessing means Channel 4... I'm guessing they thought TV 4 would be pushing it too far.
