Interplay Wanted $50 Million for Fallout MMO Rights


Bethesda [http://www.interplay.com] had taken Interplay's offer to buy out the rights to full IP - for 50 million bucks.

In September 2009, Bethesda dropped its effort [http://www.escapistmagazine.com/news/view/94655-Bethesda-Sues-Interplay-Over-Fallout-MMO] to force Interplay to stop work on the game in April 2010, although the lawsuit (and Interplay's counter-suit) continues. But Interplay President Eric Caen says Bethesda could have had the Fallout MMO if only it had been willing to pay the asking price.

"[Interplay CEO Hervé Caen] said, 'If you want the full IP, the value of it is $50 million.' They said, 'No way. Why $50 million?'" he said in an interview in Edge Magazine. "We said, 'Because the MMOG strength of this universe is huge.' Bethesda said, 'We don't want that. Let's buy everything else but the MMOG. Do the MMOG.' They said that Interplay had to start development and by a certain time we had to have a full game in development."

That time clause is what eventually sparked the lawsuit between the two companies, although Caen said he thinks the real motivation was Bethesda's delayed recognition of the true value of the franchise. He also thinks Bethesda was surprised by the fact that Interplay was actually able to rise from the grave and get moving on the project.

"They bought everything, but left Interplay with the license to do the MMOG - under certain conditions, thinking that Interplay would never fulfill these conditions. But Interplay did. Spring 2009 - this is public information - Bethesda sends a termination letter to Interplay, saying, 'You did not fulfill your obligation.' So all the litigation is about that," Caen continued. They said, 'OK, how can we get that without paying?'"

For now, the two sides seem to have reached a sort of detente. Bethesda is reaping the rewards of Fallout Online [http://www.amazon.com/Fallout-New-Vegas-Pc/dp/B002SU4QG4/ref=sr_1_3?ie=UTF8&qid=1287771574&sr=8-3], previously known by the codename Project V13, continues apace at Interplay. Assuming there will be no other litigational speedbumps to slow things down, Fallout Online is expected to come out sometime in 2012.

To be honest, I would like to see this happening. On the other hand, if a studio can't get its head out of its collective arse and release the product (looking at you, 3D Realms), you have a disaster waiting to happen...

I know what you mean. Isn't the whole point of Fallout that you're one of the survivors of a massive disaster?

My basic attitude is that this whole situation is bloody retarded.

To me the whole thing seems like Star Wars all over again, with George Lucas selling the rights multiple times, but then ultimatly getting tbem back no matter what as the original creator.... this in spite of battles with companies like "Dark Horse Comics" and a smaller fiasco over a group of young-adult prequel novels ("The Glove Of Darth Vader", "Prophets Of The Dark Side", etc...).

In the end it's Black Isle and Interplay that made Fallout what it is, even if the gaming market was a bit smaller when the earlier games came out. Bethesda wants the money they feel this liscence can still bring in, BUT at the same time I think it's a pretty decent number of people who feel that it really takes the original creators to do the project well. For the most part you had a lot of people who were very critical of the writing for "Fallout 3" with a lot of fans like me taking the approach that it was a great game, but just not a "Fallout" game. With "New Vegas" we have the complaints about bugs, and of course a lot of Bethesda fanboys, but for the most part people seem to agree that the writing and design is much better and that it's keeping more in the spirit of the original games.

Like it or not, without the back history and so on, there is no point to even having the "Fallout" liscence, if your just going to ignore that and do whatever you want, you might as well start an entirely new IP.

As a result I kind of think that Bethesda should be trying to make good with the original Fallout companies (which they have to some extent with the Black Isle remnants at "Obsidian", hence "New Vegas").

In the end, it's always going to go back to the original team, just as in the end Star Wars fandom pretty much wound up siding with George Lucas (along with the legal system, though it was very dubious).

I swear, it may because I'm a big Bethesda fan but everytime Interplay has a go at them it just sounds like they're whining. All I got out of this article was "Wah, they didn't give us $50 million."

How much is a Fallout MMO ripoff worth? Cause it seems like Fallen Earth is still floating around out there.

but Interplay NEEDS to bring back Atomic Bomberman, NOW

but for now, I'll just stick to the original one in my Win95 pc

I really can't see a Fallout MMO working in any way, shape, or form. I'm siding with Jaranja up there- the entire feel of the world is supposed to be that it's almost empty- thousands of dudes running around collecting 10 Super Mutant Foreskins or whatever would snap the atmosphere over one knee.

I'm not hatin', yo'. I just think it's the way Interplay puts themselves across. It's like they're the good guys and everyone else is out to get them.
