The lawsuit also claims that Activision fired West and Zampella because the duo had "morphed from valued, responsible executives into insubordinate and self-serving schemers who attempted to hijack Activision's assets for their own personal gain."
In my opinion, Activision is the pot that's calling the kettle black.

Having just read the entire document I think its safe to say W&Z are fucked.

The start seem to be discourse painting a picture of how ungrateful W&Z are, but later on it seems like they have some pretty solid case. Of course this isn't the full picture, Activison likely left out all their misgiving and twisted some facts.

It will be interesting to see the outcome.

"Boom boom pow. Away."

Ah now this gonna get fun, I think from now on I'm going to remain impartial to this for the time being, as a member of Activision told me, sometimes news can be distorted, we'll find everything out once this whole affair is over.

"When Activision prevails in this matter, it intends to reallocate any share of the Modern Warfare 2 bonus pool that might otherwise have been payable to West and Zampella to those employees responsible for the success of the game who remain employees of the company subsequent to the resolution of the matter."
I just love the wording. Activision will PREVAIL!

OT: I get the feeling this is going to be a he-said/she-said kind of matter. And since a lot of people kind of think that Activision went a little too commando at IW last month, this is not going to end well for them.

I'm not sure whom to believe, but it's sad that in either scenario you've got some people high up in the gaming industry who are fundamentally dicks. It all makes compelling drama though and is one of the few stories in the gaming world I?m more than happy to keep up to date on.

I'm not sure how EA are involved now, but I?m hoping that it was a baseless accusation as I?ve really started to like EA over the past couple of years.

err why the reference to them seeing EA? Last time I checked employers can't stop you from looking for another job at all, so long as it's not on company time, sure it might impact promotion chances, but they can't sack you for it.

Well at least that's how it is in Australia anyway. I remember reading somewhere that the most common accessed website on Australian business networks after stuff like gmail, google, facebook, and news sites are job sites. Seriously corporations are getting really stupid and hypocritical, they show zero loyalty to their workers, because all that matters is the bottom line, but get all stroppy when the workers start thinking the same way i.e "what is the best thing for me?".

EGADS! Business? In gaming? BLASPHEMY!

Seriously, even the so-called 'good guys' (Rare, Naughty Dog, EPIC) are in it for the money to some extent. Gaming is a business, just like music, just like cinema; so I don't understand why Activision shouldn't be allowed to treat it as such.

Tell you what, you guys stop buying the shitty ports and 5-minute wonders, and they'll stop producing them. The joy of a sector so heavily influenced by spreadsheets is that you really can vote with your wallet- a welcome counterbalance to any auteurs parading around with full creative license.

Empathise with Activision, one of your key design teams is about to be gutted and moved over to a competitor: would you stand back and let this happen? I speak for myself when I say HELL NO.

Besides, we have a full legal system designed to root out the exact nature of events, which is currently in the process of doing exactly that. Lets save the mob lynching until we've got a mugshot of the villain, yes?

Question: Why can't West and Zampalla meet with whomever the hell they want? Sure it's suspicious, but is America not a free country with free speech? You shouldn't be fired for meeting with someone. I mean hell they WORKED at EA, couldn't they just say they were having a get together between old friends?

Well now it's official. SOMEONE was lying and now probably trying to cover it up.

Accusations of forgery and lies have been thrown around far before this so I don't know what to believe. Anyways from what I can gather W/Z definetly wanted to leave Activision. They probably wanted to take as many employees with them as possible but I don't know what IW's employees' general opinion was. Basically you've got both sides claiming the other was unfair to IW's employees.

Both sides make sense too. Activision probably would want to do everything in their power to ensure that IW keeps making CoD games for them. But it comes down to if you believe W/Z would be as disruptive as Activision claims they were trying to break off with Activision.

Is there anyone else who wants to email Jeff Brown and give him an internet high-five for that amazingly classy insult?

John Funk said:
Thoughts? Sure. One of them is right, one of them is wrong; both of them *could* be right, I don't know which one is.

Activision has now provided actual examples of how it claims West/Zampella obstructed royalty payments, W/Z have not. But, it all comes down to whether you believe them or not.
Do game companies employ secret agents? Wow, what would that job be like? With all the information that Activision has supposedly come up with, they must have secret agents keeping watch.

To me, this whole thing feels like a bad soap opera:

Everybody thinks EA and Activision are mortal enemies but in secret they are lovers and EA is having Activision's love child. While all that is happening, Activision's little brother, Infinity Ward, is in a coma, and Activision claims that West and Zampella poisoned Infinity Ward, and Activision possibly has the proof...but maybe not.

The truth, as always, is probably somewhere in the middle. I'm sure they did plan to break off from Activision and bring their freinds with them. And i'm pretty sure they didn't 'steal' bonus's to do that.

Seriously, F*** Activision they own rights to too many game franchises, and now they've teamed up with Blizzard the biggest money vacuum ever. I wouldn't blame the Infinity Ward leads for leaving at all. Activision has continuously let Treyarch ride their coat-tails on every MF'ing CoD sequel. I hope that these guys can go somewhere, where they can have a little more freedom and start creating some military/action games outside the norm.

As long as they make MW3 right, cause I wanna know what happens with Soap and Price, I don't really care who wins what.

There's more than meets the eye in all of this, I get the feeling that both parties are in the wrong some how, neither of them will back down either.

"We don't have the time to comment on the many lawsuits Activision files against its employees and creative partners."

That still made me laugh though.
