I wonder why things like Counter Strike, Unreal, SOE/EQ, etc... weren't included?

Me thinks it's because they're just looking for a quick cashout-settlement.

Didn't we have online tourtements in QUAKE?

And why have they waited eight YEARS to file, and going after the biggest third party developer in the industry? You know how much they can afford to pay lawyers to fight this case?

Not necessarily to that second bit, broad ranging is a matter of opinion. :p
Although that's an interesting point. Activision Blizzard have uniformly avoided servers in general. CoD6, WoW. Most of the stuff they do is P2P. So the suit actually has a chance of succeeding, if only because the company can say that if A.B. is avoiding it, they must know that it's been copyrighted, which means any violation is willful.

if online gaming does get banned because of the lawsuit, one can only imagine the amount of people who wont be able to adjust to the sunlight out-doors :)

this reminds me of when the wright brothers tried to sue curtiss over the control mechanisms for curtiss' aircraft. according to them, their patent for the wing-bending way of controlling the plane gave them rights over all other control schemes, including the far-superior ailerons that we use today, which were developed by curtiss

How do you even patent something like online tournaments?? and why would you sue only activision. TONS of games have online tournaments. something smells fishy and greedy...
At the heart of the matter is a patent issued to Walker Digital in 2002 for a "database driven online distributed tournament system." The expanded patent describes "a method and a system for a distributed electronic tournament system in which many remotely located players participate in a tournament through input/output devices connected to a central controller which manages the tournament."

The united States patent office stopped being funded by tax dollars several years ago and ever since the only thing keeping the office afloat is patent fees. So the office is now willing to patent anything as long as those seeking the patents are willing to pay the fees no matter how stupid.

Unfortuantely, due to some silly changes in the US patent system over the last few decades, it is. It is perfectly possible to patent a concept even when you have not produced a working implementation. It is perfectly possible to do so after someone has already produced an example that would infringe on your patent. It is perfectly legal to then sue for compensation where there is an unsettling trend of the success.

I wonder if Walker Digital realizes that if they win and for some reason activison-blizzard closes down just how many millions of angry people will unify in order to not only murder them all, but also wiping all trace of their dna off the face of the earth so that future generations dont accidentally clone them.

Hell I think its in Korea, guilds will send out hit squads IN REAL LIFE in order to beat someone down who humilated them in a game. Have fun Walker Digital

I thought you had to ACTIVELY protect your patents to have any right to them, and waiting NINE YEARS certainly doesn't seem like they cared much.
