Not one to play it myself, but I do appreciate the importance of keeping World of Warcraft playable, as it existed in its various stages, as authentically as possible.

3: More of a personal thing, but this type of 'crime' is not the type I think people should face jail for, maybe community service or garnishing their income to a reasonable degree. They shouldn't have their lives destroyed over it.
Not even that. The server itself is not against TOS as they never signed one to begin with. The ONLY people breaking the TOS are players using the client to connect to the private server.

This is not a crime to begin with, so no jail for sure. Dont get fooled, just because Blizzard abused takedown notice laws does not mean that Nostralius was illegal.
