Am I in the wrong here? Piracy question

Ok so let me elaborate. I bought the Heavy Rain special edition on its release day and with it came a code for the theme, dlc, and game soundtrack. There was a screw up at sony and people who redeemed their codes wouldnt get the soundtrack. Anyway after contacting them I didn't get a new code and no one did anything about fixing it for me despite continued pestering so I just let it go and played on. A few months later and I want my god damn soundtrack. Since I technically own a copy of the OST is it illegal or immoral for me to download the soundtrack from a fileshare site to get what I paid for?

Because you're still downloading it illegally. Yes, you didn't get what you paid for and morally you are completely in the right, but it's still illegal.

You are supposed to have a copy of the OST. It was included in your purchase. Said copy was never delivered.

I'd say piracy is ok in this case. Get what your purchase entitled you to.

Thats fracking stupid. It's their fault I couldn't download it legally.

Would the OP's case stand up in court though? Should Sony feel cheated and take him to court.

Indeed it is, but that's how things go. I say go ahead and do it; at the very most you'll likely only get a warning if anything is going to be done about it, and nothing is likely going to be done about it.

Its a matter of opinion I suppose. In the end, the only opinions that matter in this case are yours and anyone who could prosecute you (if any). Doesn't matter what all of us here think really.
Even if a majority thinks something is right, it might not actually (legally) be.

It is legal to download a copy of a product as long as you legally purchased the same data. I believe this comes from the laws regarding the legality of copying data without redistributing it. The money paid upon purchase of a game is more of a purchase of the right to use the game's data and less of the data's physical transport.

For example, I recently purchased Saints Row 2 on steam. However, steam was causing slowdowns and disallowed modding, so I downloaded a pirated copy in order to run Saints Row 2 outside of steam. Legally, there is no issue with this.

you,re right you are allowed to make backups of existing CD,s and movies so you can lagally download the OST
