Since we don't know exactly what is wrong with the flash drives, then it's difficult to tell. But Ubisoft as a company isn't to blame, although they would be legally viable for blame, the true error likely lies in the USB drive manufacturer, or the people filling the drives with software. Either way, they did what they had to to compensate potential buyers.

Why do people care? Collector's edition sets are the most gimmicky thing ever. I remember once when I was young and naive I paid extra for the Age of Conan Collectors Edition: for a hundred bucks I got an art book, a felt map, two purely cosmetic in-game items and the most broken game in years.

Good, That's another game that no man, woman or kitten could make me feel bad about pirating.

Well, not that I'd pirate it at all, I don't want anything related to Ubisoft skanking up my hard drive, but still

Except for one simple fact. Activision wouldn't tell you that the drive is defective until AFTER you bought the game.
Last I checked, the game hasn't been released yet. First release date is 13th of April for 360, and the 27th of April for PC. So unless someone's managed to get round this date somehow, no-one should have the game yet. No one has yet to open their box and find out they have a defective USB stick.

And last time I checked there's been two reviews on the game already so there are people who have had the chance to open the box. And seeing as how reviewers usually get free stuff they most likely got the drive. They might be the lucky one's who didn't get defects. Oh well it comes out in two days so we'll find out soon.

I wasn't counting reviewers in, simply because I doubt they paid for the game. I was speaking from a consumer stand-point. However, it does make sense that the reviewers may have had the issue with the drive, as it's possible that's how Ubisoft started to find out about the problem.

So if you buy this edition and everything promised doesn't work... it's OK because they took a small fraction off the price? And customers are supposed to be OK with this? I don't think that's how it works, legally or otherwise.

"Since brakes are not hooked up on 1 in 10 of these Toyotas... we knock $1,000 off the price, okay?"
