Devs may be waving the rights they never had. So nice of them, really, allowing us to do something we were always allowed to do and not trying to get more monopolistic control over things they never had a right to control to begin with. Yeah, how terrible they are not all completely insane.

This is what actually happens though. If you fail to protect your patents when somone else uses them (even if you werent aware of it), you loose the right to those patents.
