There is some examples of Virginia Court throwing out other cases like this because the law couldn't prove he was trying to be indecent. It also has more details of the case.
I don't think they got much of case and it will either be tossed in the first court or in the appeals process. The law really has to work to get these type of cases thru the court with the judges siding on their behalf. I don't see that happening especially given the time the incident occurred and what the man was doing at the time isn't considered obscene unless your into screwing hot coffee pots.

I read about this story on sankaku complex earlier today.It still makes me cry inside, knowing that such a case can actually be seriously considered. Hopefully this case is quickly thrown out of court because if this woman wins then the world has become a slightly sadder place.
