Either this article is wrong, Or microsoft is going to loose. DHL IS a shipping company, but it IS NOT a railroad (atleast not in the United States).

DHL is the contracted forwarder. They buy space on the rail and use it to move their own shipments. As such, they are still on the hook with Microsoft because it was their choice to use said subcontractor.
