My "New" game from Gamestop might not be "New?" (And should I return it?)

I sympathize with the OP.

I refuse to buy from gamestop already, and this thread is the veritable nail in the coffin for gamestop in my eyes.

I don't mean to attempt to change your mind, but I'm curious as to why you choose to not shop at GS?

When buying new from Gamestop (if you absolutely must do so) always request a sealed copy. They usually have several behind the counter and I've never had any trouble requesting one. It's the only way to avoid these issues.

Honestly, what's with people complaining about EB Games? I've bought MANY games from them, and have yet to buy something short of genuinely new.

... Maybe your EB Games stores suck.

I've worked for GameStop. Yes, we gut. Yes, we check out games. I'm not denying that and I'm not going to discuss whether I like or dislike this.

However, I will say that you can't return it just because it was opened when you got it. Sadly for you, unless there is an issue with the disk itself, they will not take it back, and even if you do have an issue, it will only be for the same game.

I've worked in a gamestop (albeit a few years ago), but we were never allowed to sell a game as new if it was a game we were allowed to test out.
In a rush or not, if someone isn't handing you a sealed game, you turn around and walk away or demand one of the many they have behind the counter.
Seriously, I've never had a problem like this nor have I hear of this before. It really feels like one of those uber bizarre cases that I don't know who to blame.

I have no issue with them taking the game out and storing it in the drawer. Honestly having worked at a used-game store (not a Gamestop) it really dosen't make much sense any other way. However if there was anything wrong with your DISC, CASE, or INSTRUCTIONS... you should not accept it. Take it back and at least ask for a new case and the booklet. As long as the game is not marked I wouldn't worry.

no question, return it and demand an unopened copy and I know they have them cause I buy from gamestop here and they have unopened copies

Been a while since I worked there, but my store's policy was to not allow employees to check out "New" copies, only used ones. Of course there are some manager's who don't really care and will let their employees do so anyway. But that's my 2 cents.

It is a fair question, no trouble at all.

The first event that disappointed me was when gamestop decided to stop selling PC games.(Yes, i am aware that i can preorder pc games at GS)

I dont feel any ill will towards GS for this decision, i did start shopping more at best buy, though.

I guess you could say that the reward program at best buy coupled with the wider selection of games (and other products...) just made more sense for me to discontinue shopping at GameStop.

To top this all off, learning that the already-overpriced games on the market might be getting sampled and then sold at the price of a new product is unacceptable

Isn't all Xbox360 games sealed from factory with the Microsoft agreement sticker sealing the opening, and by breaking that seal you agree to the user agreement? so really all the games you buy that have been opened (gutted) by any store you are not liable? because you didn't break the seal, so there for you didn't agree to its ULA?

Wrong, I read the policy and my fiancee works at a GameStop, and any "new" game that gets checked out by a GS employee goes back on the shelf as "used."

I concur with this. I actually enjoy being able to break the fresh seal off a brand new title.

Except that the information is wrong, whether you agree with it or not. SOME employees may disobey policy, but regardless the POLICY is that this is not permitted.

That hasn't happened to me to that extent. I've gotten a game of the rack and had them put a disk in from the envelope and its had the manual and such.. Never have I seen them take a cheap case and slip in the cover art. They sold it to you as new, but don't have the case or manual? Fuck that, return that game, get your money back, complain, and contact corporate if you can(at least send an email). I can understand if it was a used game, but no new game should come without the things every new game comes with.

As far as I can tell Gamestop(and probably game stores in general) are hit and miss. My favorite game store was Game Crazy and when they closed I moved to a Gamestop and while it isn't the same(a little worse) it is the best Gamestop I've found in terms of costumer service and questionable practices.

edit: One of the reasons I preorder is b/c the game is still in its plastic, which is a nice thing.

This. All this. I too work at Gamestop and it's true: Games need to be "gutted" so that people know what new releases are out. Usually, that box you got is the one people grab and bring to the register whenever they want that game. Then we pulled out a sealed copy from the draws, given we have one. You probably got the last copy. Also, if someone ever returns a brand new, factory sealed game, we have to open it to make sure they didn't pull a fast one on us. believe me, it happens. Somehow.

And yeah, I'll admit it sucks. I actually hate it when I wanna buy a game and I get the last copy. But I know it's still a brand new copy. About the manual? You can blame some brilliant kid about it, probably. You see, at least at my store, kids have a tendency to open cases and read the booklet. Maybe steal it if we look away for a moment. We usually try to keep an eye out for kids like that, but we're not perfect. If the booklet is stolen or missing, there's nothing we can do about it sadly. Personally, if that happens, I just pull out a booklet from a used copy, given the used copy has one, and stick it in there.

Checking out games. Yes, we are allowed to check out games but in most stores (It depends on the manager, really), they usually tell us to go after the used copies. If someone was to check out a brand new copy, they'd have to be EXTREMELY careful with it. A single scratch and they have to pay for it in full. So no one wants to do that. Also, it's pretty pointless since we're not allowed to use DLC that comes with the game, obviously. I check out games every now and then, even the crappy ones, with the sole purpose to get an idea of what the game is about. It's pretty embarrassing when there's a new game that came out and you cannot comment on it. But like I said, an open copy doesn't mean its a used copy all the time. If I even have to sell an open copy, I'll let the customer know first. And then if they're okay with it, I'll charge it. I also try to be as honest as possible. So you're entitled to ask questions. It takes less than 10 seconds to ask a question.


However, if your copy indeed looks worn out or used, you can go back to the store with your receipt (Or if you have the membership, it holds a record of your purchases) and ask for a better copy. You have 30 days to do that too. I've seen people return games with a tiny, almost visible scratch and you know what? We give them a new copy. As a fellow gamer, I too would be upset if my new copy had a tiny scratch.
So it's not like they're being dicks, it's just luck. Heck, sometimes people return games that were sold as brand new, factory seal and they say the game freezes. Not our fault, just luck, I guess.

Damn you beat me to it. I was going to say this word for word. But yeah, if you arn't happy just tell the employee and (if they are smart) they will help to work out a solution. And yeah, we can only check out used games and only if we have more than 3 in stock, But if all else fails, there is a survey on your receipt. Tell the company the problem. (Plus good/bad review you get a chance to win $500 in-store.)
