what was he thinking? "I'll get ahead of a world size company a release their game before them and there will be no consequences"?

Sorry for the guy but yeah this is how justice should be applied, catch the distributors not the end buyers.

My gut feeling is however that this guy must have been somehow making money off of his pirating, probably not just that one, but other games as well. He probably settled with Nintendo for 1.5 million because he made more money than that overall.
There's no possible way he could have managed to make anywhere near 1.5 million. Even $5,000 would be an impressive feat.

Could my hatred of nintendo actually grow stronger?

1.5 million? Wake the fuck up nintendo! Not all of us are swiming in dollar bills got for nosepicking!

Also, if anyone thinks this is right, then you have a fucked up sence of justice.
I do not have a fucked up sense of justice, thank-you. You appear to have a fucked up sense of ownership, business smarts, and prevention methods. Props to nintendo.

EDIT: Have to adress this:

This article [link]http://news.vgchartz.com/news.php?id=5954[/link] says nsmb wii sold 1.3 million units. How exactly did this upload harm sales? The stupid part is that even if they sold 2 copies for every man woman and child on earth they would still claim that an uploaded game had hurt sales.

And for you publicly educated mouth breathers out there: piracy = stealing shit on the high seas, distributing a configuration of bits that someone claims to own = copyright infringement

Piracy: http://www.merriam-webster.com/dictionary/piracy I suggest you look at definition 3. Failing that, the law code should help. And I can tell you right now this sort of thing does hurt sales. Ever intended to buy music off itunes but found out you could get it off linewire instead? I have. Thats sales hurt right there bro.

You'd be surprised. But hating Nintendo for protecting their products is just silly.
I don't hate them for protecting their products, I hate them for going after a fly with a rocket launcher. They pretty much fucked this guys life up over pirating a video game. I don't like piracy, but this is going WAY too far, even for a nameless, asshole of a company. I bet some murderers get off lighter then this guy did.

I know you might be a Nintendo fan, but even you must admit that this is overkill. They should have issued a small, reasonable fine, then told the guy never to do it again. If he did get a warning, then did it a second time, I wouldn't blame them, but this is ridiculous.

So piracy is wrong, but why does Nintendo invest so much time and money into a game that will sell several million copies and not the ones that don't sell so well? It's not like every game released for the system won't make it on pirating sites sooner or later, and you'd think a game that doesn't sell well would benefit more from a lawsuit than a video game staple like Mario.

Oh now I see it!

Downloading/uploading is such a serious crime, it's punishment is to ruin the entire life of the downloader!

Thanks! I'll kill the next person I'll see litering!

That's justice, right?
They're not punishing the downloaded, if that were the case, I might agree with you, but they're punishing the uploaded here, a guy who through some means, obtained a copy of the game early, and put it out for the world to have, directly stealing business from Nintendo.

Lot's of people will throw around excuses for Piracy, some of which I agree with, but this isn't one of them, especially not when it's for a game that hadn't even been released.

Anyways, I'm more curious about what they actually do with a 1.5 Mil demand, he obviously can't pay it, so now what? Take his first born instead?

Well it sucks Nintendo decided to make an example of him but tough. he did it to himself when he took it from his shop and uploaded it to the internet. Atleast they are going after the real people behind piracy instead of petty victories of the people who only download it.

Oh goody. I get this one.

First off, that graphic is not an argument for anything. The person who made it probably did so as a joke to demonstrate how the word "piracy" is not being correctly used in the cases of copyright infringement/file sharing: but news flash, the pirates started it BY CALLING THEMSELVES PIRATES. If you name one of your biggest fucking download sites "The Pirate Bay", you're kind of asking to be called a pirate, regardless of what you're doing.

Next up, no matter HOW many sales are lost off of a uploaded copy of a game, IT WAS ILLEGAL FOR THE PERSON TO UPLOAD THE GAME. Certain countries protect the downloaders from punishment: but the uploaders are clearly doing something illegal but enabling mass (virtual) theft of intellectual property.

The original article states that this man was responsible for uploading a copy that had thousands of downloads. No matter what way you look at it, he deserves punishment. The incredible sum involved is just so Nintendo can puff out its chest and say "that's right, you don't fuck with us no more or you GO BANKRUPT."

From my understanding; pirating console games is a really stupid idea, as the chance that you get caught is significantly increased with console games than with PC games, there was a thing a while back before the MW2 launch with everybody pirating/obtaining illegal copies of the Xbox version of the game or something like that which led to a bunch of IP and Xbox bans or something along the lines of that.

The moral of the story: Console companies don't play with that pirating shit.

No normal person could pay that..
Then pay with your blood!
fff.. *Runs off.*

On topic. It's a little harsh. If a game company can infringe on someone else's privacy for sometihng as little as that, Imagine what they'd do to others?
