I'd always say it's completely cool to download a game when that happens. You have a real copy apart from one part so it's obvious money has been handed over at some point. And I doubt you'd ever be caught for downloading a game, seeing as there are people who do it every day. So really it's a case of assuaging your moral conscience.

Normally, when I lose a disc, it's because it's in the disc drive of a computer or laptop that doesn't work anymore. I remember one time when I was young and stupid, trying to dismantle the hard drive to get back a game, because I didn't realize that the little pinhole by the eject button was for an emergency eject.

I've never lost a disk or cartridge, as far as I'm aware, because I always keep organised. I make sure everything is put away properly or, failing that, that I know where my things are. So then if anything does get lost, I know it's not my fault and it means someone else has done it, not me.

For a few years I had no idea Leon was anything other then NPC that assisted you in Resident Evil 2. I simply bought used and didn't have the disc for his side of the story.

Tombi 2 for the PS1, went missing for years and when we redid the flooring in my house we found it under the floorboards..seriously.
This probably sounds like a really stupid question, but did it still work fine?

I lost my Morrowind disc. Found the construction set.

-_-
and this. I even had game of the year edition. All I can find is that damn TES Construction Set!
Ok, I think they must have made those disks out of something that disintergrates as I have 2 copies of Morrowind and can only find the 2 TES Construction Set disks :(
It's true! TES Morrowoind was made from spare dwarven relic parts just laying around the Bethesda studios.

A guy agreed to sell me the Orange Box for 5$ and emailed back later saying that the disc was absent from the case. :/

Does that count a little?
Well....you asked for a box, right? :p

(Apologies, but bad jokes have a way of forcing themselves to be made)

OT: I'm sure this is a murky dank grey area, but if you've paid for a game, you've paid for a game - not a CD, ergo I would have no moral difficulty in downloading the offending disc off your local Smugglers' Den....

My third disc of Final Fantasy XIII was missing. I took it back to the shop and they didn't give me a refund saying that he put all three in and I must have removed it. Riiight...
That sucks!

That's the best part of the game, in popular opinions.

I preferred disc 2, personally. More linear, but the combat had gotten deep enough to challenge me by that point.

Yes, worked perfectly. I was throwing pigs into bags in no time :p

I've certainly had it happen but there really is no solution that is entirely acceptable. The "correct" (as in, you do not operate in moral and/or legal gray area) answer is almost certainly "buy it again" but in many cases it really isn't an option and if it is, often the copy one might purchase is used anyhow. The less "correct" solution (in that you operate in a moral gray area) is to simply download an image of that disc. For most, such a move is entirely moral as they have already paid for said game.

I have personally used the latter more than once. I wanted to finish Planescape: Torment for example but was missing the second disc. Thus I simply downloaded an image of said disc to bridge the gap. Of course, I have also re-purchased a game because of this as well, hence why I currently own three copies of Diablo 2. Or rather, I have one complete copy and several copies of specific bits of it.
