I've noticed quite a bit of heated debate lately over homebrew and whether or not it is piracy. I don't understand where all the arguments are coming from. It seems to me that when this sort of thing happens on the PC as opposed to a console, there is no problem. If I take my copy of Windows and modify it to better run an application I or someone else made, there is no accusation of "Pirate!!!", yet if I do the same for a console, the immediate response is that I must be a pirate and be using it solely to download games illegally.
Then there is the argument that the manufacturer somehow "owns" the console, and that I just bought the rights to use it off them. At least in America, this was deemed illegal in the case where Apple attempted to sue people for "jailbreaking" their iPhones. It was ruled, in a court of law, that they had purchased the item itself and were allowed to do what they wanted with it (provided it didn't break some other law, like using it as a murder weapon or something [extreme example]). Why is this argument coming up again? I have full faith that Sony will be told the same thing, provided the person they are suing can afford a decent lawyer.
I personally do not go in for any homebrewing myself, as I don't want to tamper with my machines and risk them becoming expensive doorstops, such as recently happened with some people's PS3s. However, I don't see it as the exclusive home of pirates. Just because something could be used for illegal purposes, doesn't mean it is going to be, or that it is "bad" or "evil" in and of itself. After all, you could point at any object in a room and I'm sure someone could use it for some illegal activity. Granted, some would be easier than others, but I don't think we should condemn kitchen knives, for example, just because someone, somewhere was attacked with one.
So, escapist, come, tell me your opinion on homebrew, and please, back it up with well thought out statements and any evidence you can find. As always, please try and keep it civil.
