I'm gonna have to say no, and say it both with ease and proudly.
First off, never trust metacritic cause most of what you see is fanboy praise or fanboy rage. Want a good example? Look at Modern Warfare 3 and how many people who haven't played the game but don't like the series are giving it between 0-3. I wouldn't be surprised in the slightest if at least 75% of the people who praise it so greatly were Bethesda fanboys who think everything they make is pure gold.
Second, there are still a good amount of genuinely good games that have yet to come out or be reviewed that could take the title away(I'm looking at you, Skyward Sword). Until those games are out and all of Skyrim's competition has been considered, played, and reviewed by the masses, you can't claim that a game is GOTY.
Side note: OP seems to have some heavy bias though. From what I've seen, when someone calls out that Skyrim won't be GOTY he gets defensive...
