Poll: identity theft

my teacher once had a funny question on the board. If an identity theif steals your identity, and you kill the person that stole your identity would it be considered suicide or homicide?

He also told us that there was a true story in which a man in new mexico killed an illegal immigrant that stole his identity because a funny loop in our law system forbade him from using legal action against the theif.

It's murder. Identity theft isn't as glamorous as it sounds, and in most cases only consists of someone using your credit card numbers and personal information to steal money from you. It's not like they actually 100% of the time walk around with an ID card with their face and your info.
