I'd say it depends on the situation, and the flow of the sentence. I'd rather have a good flow in my sentences, and have it easily read and understandable, than keeping every little rule locked in stone.
I stick to the first one but sometimes I feel like we should just get rid of that 'and' on the end and only use lists.
E.g. I went shopping and bought: some tea; some decaffinated coffee; some ordinary coffee; some milk; some demerara sugar.
