i assume the guy was wasted and the lighting was bad but still, its not hard to tell the difference between 15 and 18. i can honestly say ive never asked to see ID, seems like that would kinda kill the mood. then again, i only sleep with girls with whom im in a relationship, never done the one night stand thing

No. Absolutely no. The illegality of sex with minors comes from the fact that they cannot consent. That they can gain entry to a nightclub does not change this fact. And given that it is well known that minors often get into nightclubs, so "picked her up from a nightclub" does not entail "she's over 18".

Seriously, so much trouble could be avoided if you say, "You look young, do you mind me asking how old you are?" Sure, you might miss out on consenting sex with an adult if she is over 18 and takes offense, but, on the other hand, you are less likely to commit statutory rape, which is an all-round plus in my book.

You should still get in trouble but she should also get in trouble for being in a club when underage.

You should get some form of punishment, simply because its one of your obligations as an adult to actually make sure the person you are having intercourse with are in fact above the legal age in your country. But there are a few weird cases.

Take Norway. The legal drinking age (for contents below 20% (or something.. maybe 22%.. not sure)) is 18, and you may have intercourse with a 16 year old. So, even though the person was not old enough to drink, the person could have been old enough for it to not be pedophilia.

However, if you are in a country where the legal drinking age and the legal intercourse age are the same, then yes, you should get punished.

However, your sentence should be mild, and just sort of a reminder of the fact that its YOUR responsibility as an adult to make sure what you do is a-ok!

Underage is underage as far as criminal courts are concerned, even if she had very convincing fake ID. There's no 100% foolproof way to make sure she's 18+ but it still falls on the adult's head even when they're drunk. When in doubt, walk away.

Peadophillia is sexual assault/rape of a pre-pubescent person so no it shouldn't be treated as peadophillia. As for whether a crime that has been enforced has been committed (assuming the sex was as consensual as possible when it is argued a minor can't consent) personally I feel the club should be prosecuted for allowing entrance of minors/serving of alcohol to minors assuming they did not have legal ID. The "legal" ID issue is relevent as Traci Lords was in pornography before she was 18 but had completely legal ID so whoever checked her age did everything they could be expected to do.

Uh? It's illegal because she's underage. It's your job to find that out, not the god-damn security-guards. If she lies to you, fine, but it's still illegal. I don't get what you are trying to prove.

Well, here in Denmark the legal age for having sex is 15-16, so it is almost impossible for that to happen here. Assuming you have eyes that work.

Anywho, it may be illegal, but there isn't any intent. If she's in an 18+ place then it should be safe to assume that she's 18 or older. As long as it's consensual then I don't see the problem. Then again, where I'm from the age of consent is 15, so this whole 'statutory rape' if the girl isn't over 18 thing is foreign to me.

I hate to be all "Captain Killjoy", but that situation could have been avoided if you'd stayed out of the nightclub.

In Australia the law the question essentially boils down to "What would a reasonable person believe?"

A reasonable person would believe someone in an 18+ club is, well, 18+, therefore there would be no crime. All this is moot, of course, since the age of consent here is 16.
