Small hypothetical on Origin

Well EA have (now i have another thing to be confused about during Winter thanks to State of Origin in australia. thanks EA whoops back on point) If i had an EA account before they released origin, and i agreed to the previous terms and conditions, and EA then changed it to an Origin account without my knowing (because let's face it i only bother with that shit because i want to access multiplayer on Bad Company 2) and i haven't agreed to the new terms and conditions because they haven't been prompted to me, would that mean i can do a class action lawsuit because i have never been prompted with an updated ToS? and is that even legal? :S

i think i might've confused myself on me own hypothetical.

I think to use to service, you gotta update it. When you update it, you have to agree to teh new terms. And you can't sue them if something didn't happen to you. Which it can't have because you haven't updated it.

thats the thing they never prompted me with the new ToS. and by now i think all accounts have been converted.

Yes and no. Mostly yes. And no. Er. Depends how well you read their previous terms, as I believe they thought ahead and covered their ass on this one. :p

That class action lawsuit clause would never hold up in court in the first place. You don't have anything to worry about.

What? I was saying that you would be able to file a class-action, and their clause preventing you from doing so wouldn't hold up.

OT: It doesn't matter if it is or is not in the ToS, it's only in there for the lesser intelligent people to go "Eurgh, I can't sue them!"

Did you read the original ToS? They reserve the right to change it as they wish. You agreed to that the first time you clicked "I Agree".
