So ya, I just started a business(name disclosed for now), and set up the website for it through a hosting service. But I just found out that there is already another business using said name. From what I can tell, both are our businesses are relatively small, mine being a website design business using .ca for its site, and the other one in question being a small landscaping group in the US using the .com for its site. After just relizing this, I've been in a panic over this if I could possibly got sued or whatever for all of this =S though neither of us seems to hold a copyright over the name(I don't think)...I did go through all of the registration stuff for a business in my province/country which I thought that covered this kind of stuff...(sigh..)

Should I really be worried about something like this? or should I try and change my stuff posthaste(even though I just bought it) or try and claim copyright or something? =S

Well if it isn't copyrighted you can probably just copyright it yourself, and then you'd appear to be good to go.
I'm not 100% sure, though.

So you have like a registered business number/code/license with the business name on it?

If so, then you're fine. You may get some confusion between the two companies from time to time but that's no biggy.

Ya, got the whole registered business license thingy through my whole government's thing for it.
So that means everything is good to go?
I just wasn't sure, because my business is Canadian while the other is American, and all the other confusing stuff that could happen with all that, involving the whole sueing process T_T

Sounds like you're fine, if worse comes to worse you'll get someone contacting you and asking for the wrong company. Go for it, the world needs more businessmen who think before they act and sounds like you're doing good so far :)

Website design versus landscaping? I mean, you should probably copyright but I don't see it being an issue. There's probably dozens of Joe's Coffee Shops and Tom's Auto Repairs, and they don't conflict.
