He didn't kill anyone, or destroy anyone's property...he cracked his own Playstation, and allowed others to do the same. What trouble did he cause?

Well it's not really his responsibility if someone uses his hacks irresponsibly. That's like blaming the inventor of alcohol for drunk drivers.

When the creator of alchol first concieved it, I doubt he ever imagined that people would get wasted on this and drive giant metal things on wheels.

This guy most likely knew it could and would be used for piracy, but didn't care 'cause he felt he was safe 'cause he wasn't pirating.

I know you don't know why he did it, because I don't know why he did it, and in the words of Bill Maher: I guarantee you do not possess powers that I don't.

Anyway...that's not the point. The onus of proof is on you. You are the one who believes he should be thrown in prison, and have his freedom taken away. It's called the presumption of innocence, innocent until proven guilty, and it's the cornerstone of the modern justice system. I don't have to prove anything, you do.

The DMCA is Criminal? Here I thought it was civil law. There isn't anyone who has been criminally prosecuted for DMCA violations before, why would this be the case now?

It's both. And I believe there was a criminal prosecution recently initiated but it was eventually dismissed (if you're interested, the case was covered by this site).
