I'm actually on the side of the university, there were already questions about her suitability as a teacher and it would appear that the picture was the last straw. I've worked in education before and you do have to be very careful how you act. By entering the profession, you essentially agree that you will try and be a good role model. I think some people underestimate how well kids know their way around the internet, and if the university found the picture, you can bet her class would have as well.

this has been happening for years, there are dozens of cases almost exactly the same as this one.

If it was just the picture, I think no harm done, but seeing this newpost, it also said she just sucked at teaching.

I'll side with the university.

I think there's more to this than just the photo... both the summary here and in the linked Chronicle article mention the photo's caption, and the Chronicle says it mentions her supervising teacher unfavourably. I think it's likely that the caption (which isn't quoted anywhere, and I ain't gettin' MySpace to see it if it's still there) was a cheap shot at her supervisor after the negative performance reviews and that'll get you sent on to the next stage Progressive Discipline (for unprofessional conduct, if nothing else) where I work too.

Note the teacher-wannabe's earlier appeal on procedural grounds was also denied; I sense some desperation behind this (failed) First Ammendment appeal.

The court's ruling added that while the picture was unprofessional, the real issue here was her having of a MySpace page, thus contributing to the decay of society.

Well that's why I'd take away her degree. The last thing we need is more high schoolers, lousy bands, or generally anyone with MySpace pages.

They downgraded her education degree to an english one...
Surely she should have argued against the stated reason for her punishment, ie: her low performance as stated by the school, as this can be clearly assessed in court. I'm guessing that the reason that she didn't was that she knew she was a bad teacher, and was looking for anything else to use to sue them with.

I'd do her, aside from that, yeah she should appeal... she definitely got scammed on this, that's bull that they can use MySpace as a weapon against her. Everyone does something stupid in their lives, let them have fun, and for you people who say you haven't done something stupid... your life must really suck, and be pretty boring. Because stupid stuff, is usually the most fun.

You guys, uh, seem to have missed that this was her second appeal already. She got denied her degree; strike one. Her first appeal was on procedural grounds, that the process used was flawed, and it got shot down; strike two. This appeal, the second, was on Constitutional grounds and that got shot down too; strike three.

I'm thinking Little Miss should just take it gracefully and walk away from the plate now, before she makes every teachers college in the US treat her future applications like toxic waste.
