Studio Surprised By Anger Over Unauthorized Game Port


A German indie development team says it copied the game Magnetized and released it on Xbox Live Indie Games and Google Play because they thought they original developer would be happy to make some money from it.

Back in April, a Taiwanese developer by the name of Rocky Hong created and released a game called Magnetized on Kongregate [http://www.kongregate.com/games/rocky10529/magnetized]. It's actually a pretty clever little game and has been fairly well-received, with over 280,000 plays and a rating of 3.7 out of 5. That was apparently enough to attract the attention of German indie studio Connect Media UG, which copied the game and released it on Xbox Live Indie Games as well as for Android and Windows 8 devices - all without the permission of the original creator.

Amazingly, the two-man team claimed it thought it was doing him a real solid. "We tried to contact Rocky some time ago about bringing the game to XBLIG and Android. Our offer: We'll take care of the full development work of porting it and publishing it to several stores giving him 80 per cent of the revenues," Connect Media UG said in a statement. "The game would have sold for $1. After the stores taking 30 per cent this would be $0.70 total and $0.56 for him and $0.14 for us. We were so sure that he would be happy that someone will port his game to other platforms and that he'll receive a fair share of the revenues, so we started development."

But Hong didn't reply, so the duo did what, in their estimation, any normal studio would do: They went ahead and started selling it on XBLIG and Google Play anyway, confident that he would be thrilled with the deal. When no reply was received even after they'd released the game, they claim they were just about to take it down when Hong sent them a message that, to their surprise and dismay, was something other than happy.

"He told us to remove the game from all stores. So we removed the game from all stores immediately," they said. "On Android it was gone after two hours. On XBLIG after eight hours. The game has been sold about 80 times."

The studio told CVG that it would try to give all the revenues to Hong and apologized profusely for assuming he'd accept the offer to port the game. CVG also noted, however, that a Connect Media UG press release for its ports of Magnetized makes absolutely no mention of Hong or the fact that the game is anything but an original work.

Hong sounds like a fucking moron. If I made a game and someone else offered to do all the work and give me 4/5 of the profit, I'd be like..."Yeah, let's go with that."

Obviously it's dumb to just assume you can do something without a developers explicit permission but they were basically offering him free money and he said no.

It's hard to decide who's more foolish.

You two don't think its possible that the guy just had some integrity and didn't want to sell a game that was previously free?

Well at least the devs were forthcoming in this, if that was Zynga or EA they would have pocketed the lot and possibly sue him afterwards for copyright infringement.

But never the less you always make it clear you are in business, just because something sounds great to you doesn't instantly apply the same to everyone else.

This makes suspicious, like those Connect Media guys tried to pull a fast one and are now conjuring up some kind of excuse.

Either way, they're idiots to think it would go unnoticed.

I agree, it seems to me more like they were hoping to Zynga their way through this and make some money but got caught out and are trying to cover their arses. I don't think it is too wild to imagine that they never sent him any messages in the first place. It's also disappointing that this was an indie dev trying to rip someone off (not that it never happens elsewhere).

It's also interesting that, according to this article, the ports made no mention of the original creator of the game and that it as in fact not an original work of the outfit porting the game. Makes you wonder about whether they did actually contatc the guy at all. He never responded to their proposal? How terribly convenient...

Never a good idea to go into business with criminals, considering they blatantly stole his work and sold it for their own profit I'm guessing it was a good thing Hong didn't go into any business ventures with the two scum.

Aww come now, while I agree it would've been a bad idea to get into business with anyone who thinks it's a good idea to work on something that's not yours without the owner's permissions, they offered them most of the money they'd make off it... That's enough to prove that they're not complete scum. Just a bunch of well meaning morons.

It's entirely possible that none of that actually happened and they're just trying to cover their asses. I'm not saying that's what it is, but it's certainly got some overtones that hint at it.

Anyway, I'm a bit skeptical that they even contacted them at all, but are only saying that now that they've been caught. I mean, who in their right mind would assume this would be okay?

After making an offer to port a game for part of the profits, only a psychopath would think, "Gee, we haven't heard a response from the developer, so it must be okay." If psychopath is too harsh for you, then please substitute fraudster. It also makes sense that it was a complete fabrication that anyone actually tried to contact the developer.

How kind of them to only take 20% of the profits for the complicated process of submitting the game to Xbox Live and Google Play, something Hong already did without their help for Kongregate. I can't picture these guys as very well meaning since they stole a free game and sold it to people, their whole story of Emails don't make them any less criminal scum, just funny criminal scum.

Yeah, he's totally a moron for not putting his reputation and the reputation of his game in the hands of two nobodies that no one would have heard of were it not for them being so above board that they just went ahead, stole his game, and did it anyway.

These guys were the fucking morons. If this Hong fellow is interested in porting his game, he can either do it himself and get all of the revenue, or approach companies himself.

So by that statement you completely believe the words from two guys that "Borrowed" an already known free flash game and decided that it was almost guaranteed to make a buck without the creator knowing it was being sold without his consent by strangers.

I don't know about that man, I would be quite suspicious if one day i started receiving free money in the mail for a questionable reason. Besides what's to stop them from keeping most of the profits for themselves? afterall

the 20% would be not for submitting but for porting work. supposedly. because you know, its not like Androids can play flash natively anyway (dont know about xbox).

Looks like Hong had integrity to keep his free game, well, free.
