When does art become yours?

I understand that you are the owner of anything you create. That can get complicated sometimes, but by default that is the way it is supposed to work. But at what point does it become your creation?

Let me explain. When I was in college I had a professor that liked to paint scenes from movies. Those paintings were his and he could do whatever he wanted with them; display them, sell them, give them away, but them in a book, whatever.

But if he had just been printing out images of the movies, he would not have been able to do that, because he doesn't own the rights to the movies. So if he tried to sell them, or put them in a book, he would get in some big trouble.

But, what if i look up a scene from a movie and then photoshop it in some way. Is it my art then, or is it still just a scene from a movie that i don't own?
