This strike me as closing the barn door after the horse has bolted. Any cheap phone (SIM or no) or tablet can connect to any unlocked wifi hotspot - of which there are a plethora - and then send messages across the internet.

But I suppose that's the point: if this stupid law is passed, the intelligence community (or rather their political advocates) will immediately start complaining that it's useless and demand more restrictions, citing this law as precedence that everyone should accept additional surveillance.
