(Or wizard?) Not in a medevil fantasy setting and not some unfortunate old woman who happens to be aesthetically challenged but an actual witch (or wizard), here and now. Allow me to go into more detail: imagin that you, through some convoluted set of coincedences, are the judge, jury and executioner of an actual magic user, in this world. The trial has been rushed for reasons that will shortly become apparent and so very little is known of the magic user's capabilities or background.

What is known is that they are capable of causing death through their powers alone, however it is not known on what scale. Mabey they can kill a single person by a look, mabey it takes a complicated setup involving tarrot cards and sacrifices. Or mabey all they have to do is think of a city and -BOOM- gone. You know nothing about this person's mentality. Perhaps they are good and pure, perhaps they are evil. The only thing you know is that they have not killed everyone at the trial to escape, but whether this is due to unwillingess or incapability you do not know.

What do you do? Is the risk too great to leave this person alive? What if they are peaceful but powerful and wreck havok when you try to kill them? Mabey imprisonment would be better... though what if they could open locks with a wave of their hand? It is likely that if you try to commit an 'evil' act against them (even if for the greater good) that people will die. How many and how painfully, again, you do not know. What actions you take, including how you have them killed if you choose that, are up to you entirely.

And finally, no getting to know them better! The trial must be ended now, with a firm decision.


Personally, knowing nothing about their background or personality I could not commit them to death. Niether could I commit them to imprisonment, for they are not known to have broken any laws. If they have not used their powers to destroy the trial and kill everyone there I would doubt that they would cause destruction for fun, and I think the best solution would be to learn from them with their co-operation to try to establish a defence against a magic user who would choose the option of leveling a city just... well, just 'cause.

I'd get some sweet spells for saving the witch, who cares if she might be evil?

If the magic user can kill by sight, sentencing them doesnt really matter now does it? See in the modern world we have a little rule called innocent until proven guilty. The default ruling is always going to be innocent until evidence is provided t odemonstrate their guilt. For a trial like this to be rushed in the modern world...it doesnt make a whole lot of sense.

Only way to stop them would be death, and either way i say thats a no go.

No. Magic is a hammer. Just because some jerk might hit someone with it and steal their money doesn't mean you ban hammers as this would result in the many more useful applications of hammers being impossible (building atc)

The only recorded incident of supernatural abilities, and we'd burn it? No way.
I would put the spellcaster under supervision to learn more about the abilities he/she possess.

Seriously though, if no crimes have been committed then probably not.
If they don't seem to have a hostile personality I would probably recommend some sort of supervision? Maybe something less intrusive, like a psudo buddy-system with someone they can be in frequent contact with under the guise of bettering the understanding of the general public?

Interesting point, though don't they have at least reason to suspect (I realize not always). That's a tricky subject but if you had reason to believe someone was trying to kill your family, what would you do?

Um, back to the witch. I would prefer to have them examined by a psychiatrist but I'd like to think that I'd let them free...but I dunno.

Id make them learn control over there powers then let them live. You risk losing out in the benefits of magic if you just smoke them up.

I likely would have the person checked out by a professional doctor and if they do something along the lines of turning somebody into a chicken, then I might take action.

In all reality every person is going to have clouded and different judgments as to what a witch might be, so it is fairly hard to know what one really is if it did exist. So yes, show me the magic, or I'll probably not care.

It might just be me, but from the opening post, it seems that the witch/wizard has not committed any crimes, and is just able to use magic. Based on just that, I'd have to let her/him go. I'm not about to punish anyone for what they may or may not be able to do based on an assumption of powers they might possible have. If they do kill someone and it isn't in defence, sure, I'll execute them.

I would be too afraid to anger someone who could potentially turn me into a newt to actually consider raising my fist in anger against them. I mean think about it, what if the fire doesn't actually work? Then the witch survives and I end up.... newted and have to live out my existance as a newt. A NEWT I tell ya!
Besides I doubt magic alone makes someone evil and the last thing I want is to provoke someone with immense power to violently defend themselves.
