Keep it simple, base it around "radio frequencies" and it's clear in the menu what channel everyone is in (listening to and broadcasting to). So if you're fed up with the bullshit on one channel, tune to a different "frequency" and chat through the map. Otherwise chat is entirely distance based, you have to be close to talk... but the enemy players can hear you if close enough.
Not that there are many popular 360 games with really in-depth online that really require verbalisation of teamwork...
He has a black controller in his hand and there appears to be a Playstation 3 on the TV stand... but that headset is unmistakably for the Xbox 360 which is in no way compatible with the PS3. Which makes me suspect there is fakery going on here. Plus, although it's a low resolution video I can't see how the clearly wired headset in plugged in (the cable is very short), it could be as simple as the kid is encouraged to pretend to talk trash into an unplugged microphone.AjimboB said:

See, you can't just plug in a bundled headset. You have to look for and buy a relevant blue-tooth headset (like for phones), get it charged, and every time you want to use it get it to link with your PS3. Idiots fail at that. Idiots tend to spout abusive shit into their mics.
There are plenty of idiots on PSN, they just are silent.

Why don't we all just take a nice big breath and take a moment to remind ourselves that a couple minutes of video featuring a seven year old swearing at random people online created for amusement purposes does not give us enough information to dictate anything about the girl's personality or future or to decide if her family consists of a bunch of social leeches without morals.
Why are you limiting this to XBL? This is the way a surprisingly large amount of the multiplayer community behave (though not this situation exactly) terribly.katsabas said:

In Black Ops i'm seeing dick emblems (why anyone would waste their time figuring that out to begin with is beyond me...), nazi flags, other offensive garbage. On Halo I'm being assaulted with racist slurs and swears for making even the smallest of mistakes.
It's just, sadly, the way multiplayer seems to be. Is it any wonder my favourite games are all RPG's?

XBL has a mute button for a reason
hell most of the people i play with will tolerate a childs voice on XBL for about 15 seconds unless the kid is actually playing the game and contributing other wise its MUTE.
I personally find it hilarious so i dont mute them all the time (i draw a line at actually flooding the mic with annoyance non stop and screaming/screeching), in fact one of the best gaming sessions ive had recently came from playing BFBC2 with a foulmouthed little kiwi (no racism, just strings of curses i was surprised that an 8 year old knew) that everyone else had muted and didnt understand why i was cracking up over teamchat.
only thing XBL needs to make better is a way to record all the voice chat from a gaming session so you can submit it more easily if actual abuse is occurring
games just need to make muting easier, it'd be nice if you could just bring up the players list in most games and just hit a button to mute/unmute instead of jumping through hoops for 15-30 seconds to mute them.
